Overview

The Vocational Education and Training Funding Amendment Act 1997, enacted by the Parliament of Australia, is a legislative instrument designed to amend the Vocational Education and Training Act 1992. This Act was introduced to address funding gaps and to make necessary adjustments to the funding provisions for vocational education and training. The primary policy objective of the Act is to ensure adequate and appropriate funding is allocated to support vocational education and training initiatives in the specified years. The Act received Royal Assent on 24 October 1997 and came into effect on the same day. The specific amendments to the Vocational Education and Training Funding Act 1992 are detailed in Schedule 1, which includes adjustments to funding allocations for the years 1997 and 1998, as well as an addition to the funding for 1999.

Scope and Application

The Vocational Education and Training Funding Amendment Act 1997 is a legislative instrument designed to amend the Vocational Education and Training Funding Act 1992, thereby impacting the allocation and administration of funds for vocational education and training within Australia. This Act applies to the entities and industries involved in the provision and funding of vocational education and training programs, ensuring that adjustments to funding levels are implemented effectively. The amendments primarily affect the financial provisions outlined in Section 9 of the Vocational Education and Training Funding Act 1992, modifying the funding amounts for the years 1997 and 1998, and adding a new entry for 1999. The Act operates on a national level, affecting all jurisdictions within Australia, as it pertains to the Commonwealth's role in funding vocational education and training. While the Act itself does not specify any exclusions or exemptions, the application of the amended funding provisions is contingent upon compliance with other relevant legislation and regulatory frameworks. The Act may also extend or restrict its application through subordinate instruments, which would be detailed in regulations or guidelines issued under the authority of the Vocational Education and Training Act 1992.

Key Provisions

The Vocational Education and Training Funding Amendment Act 1997 (Act) primarily amends the Vocational Education and Training Funding Act 1992 (VET Act) to adjust the funding allocations for the years 1997 and 1998. Under section 9 of the VET Act, the Act replaces the funding figures for the years 1997 and 1998 with new amounts: $887,717,000 for 1997 and $869,039,000 for 1998 (section 9 of the Schedule). It also introduces an additional funding amount of $21,546,000 for 1999 at the end of the table in section 9A of the VET Act (section 9A of the Schedule). The Act imposes specific obligations on the entities governed by the VET Act, primarily concerning the adherence to the revised funding allocations outlined in the Schedule. This means that any funding disbursements or budgetary planning for vocational education and training must align with the new figures provided by the Amendment Act. Entities subject to the VET Act must ensure that their financial planning and reporting reflect these amendments to comply with the legislative requirements. In terms of potential breaches and consequences, the Act does not explicitly outline specific offences, penalties, or civil/criminal consequences for non-compliance. However, non-compliance with the amended funding allocations as stipulated by the VET Act could result in various repercussions. These might include financial audits, investigations, and potential corrective measures mandated by the relevant authorities to ensure adherence to the legislative requirements. The precise nature and severity of these consequences would depend on the specific circumstances of non-compliance and the decisions of the governing bodies within the vocational education and training sector.
