Overview
The Heavy Vehicle National Law Victoria - Exemption in Relation to Silage Trailers 2010 Amendment Notice (No. 3) 2015 was enacted to address a gap in the operation of an exemption that had been issued under a former corresponding law for the Heavy Vehicle National Law. This amendment was introduced to temporarily extend the exemption, which was initially set to expire on 31 August 2015, to 31 January 2016. The purpose of this extension was to provide additional time for compliance and adjustments within the industry, ensuring that silage trailers continue to operate under the specified conditions. The Notice was made under Section 23 of Schedule 1 of the Heavy Vehicle National Law and was issued by the National Heavy Vehicle Regulator, with Sal Petroccitto as the Chief Executive Officer. The policy objective of this amendment was to facilitate a smooth transition and maintain the operational efficiency of silage trailers within the regulatory framework.
Scope and Application
The Heavy Vehicle National Law Victoria - Exemption in Relation to Silage Trailers 2010 Amendment Notice (No. 3) 2015 primarily applies to silage trailers, extending a previous exemption that was set to expire on 31 August 2015. This amendment, effective from the date of its publication in the Commonwealth Gazette, is designed to provide a temporary reprieve to those who would otherwise be impacted by the expiration of the original exemption. The Notice is applicable within the jurisdiction of Victoria and is intended to maintain consistency with the overarching framework established under the Heavy Vehicle National Law. This legislation ensures that the amendment aligns with the national standards while addressing specific state-related requirements.
The scope of this Notice is narrowly focused on silage trailers, and it is applicable to any entities or individuals who operate such trailers within the state of Victoria. The amendment extends the exemption period to 31 January 2016, thereby providing additional time for stakeholders to adjust to the regulatory changes. Notably, the Notice does not specify exclusions or thresholds beyond its application to silage trailers in Victoria, and it operates independently without the need for further subordinate instruments to define its reach or applicability.
Key Provisions
The key provision of the Heavy Vehicle National Law Victoria - Exemption in Relation to Silage Trailers 2010 Amendment Notice (No. 3) 2015 is the amendment of the original exemption period for silage trailers (section 4). Specifically, the Notice extends the exemption period from 31 August 2015 to 31 January 2016 (section 5(a)). This means that the exemption allowing certain silage trailers to operate without a Heavy Vehicle National Law (HVNL) permit is now valid for an additional period of five months.
This Amendment Notice imposes specific obligations on the parties it governs, primarily those who own or operate silage trailers in Victoria. The primary obligation is to ensure that these trailers continue to comply with the terms of the exemption, which includes adhering to any conditions or restrictions specified in the Notice. Operators must be aware of the extended exemption period to ensure continued compliance with the HVNL.
Breaching the terms of the exemption or operating a silage trailer outside the specified exemption period could lead to civil or criminal consequences. Under the HVNL, penalties for non-compliance can include fines and potential prosecution. The exact penalties would depend on the nature and severity of the breach, but the HVNL provides for substantial fines, up to a maximum of $10,000 for individuals and $50,000 for corporations, as well as potential disqualification from driving heavy vehicles. It is crucial for operators to understand and adhere to the requirements to avoid these consequences.
