Overview

The Heavy Vehicle National Law Victoria - Exemption in Relation to Silage Trailers 2010 Amendment Notice (No. 2) 2015 was enacted to address a temporary operational gap in the regulation of silage trailers under the Heavy Vehicle National Law. The Notice was issued by the National Heavy Vehicle Regulator, Sal Petroccitto, under the authority provided by Section 23 of Schedule 1 of the Heavy Vehicle National Law. This legislative instrument was designed to amend a previous exemption related to silage trailers, originally set out in the Road Safety Act 1986 (Vic). The primary objective of this amendment was to extend the exemption period, providing a temporary reprieve for the operation of silage trailers until 31 August, rather than the originally specified 30 June. This Notice came into effect on 1 July 2015, ensuring a seamless transition in the regulatory framework governing silage trailers in Victoria.

Scope and Application

The purpose of the Heavy Vehicle National Law Victoria - Exemption in Relation to Silage Trailers 2010 Amendment Notice (No. 2) is to extend the timeframe of an exemption for silage trailers, previously governed under the Road Safety Act 1986 (Vic). This notice, enacted under Section 23 of Schedule 1 of the Heavy Vehicle National Law, applies to entities and individuals involved in the operation and use of silage trailers in Victoria. It is a legislative instrument designed to maintain consistency and uniformity in the application of heavy vehicle regulations across states and territories. The amendment extends the exemption period from 30 June to 31 August, thereby affecting the conduct and transactions related to silage trailers. This amendment applies nationally under the overarching framework of the Heavy Vehicle National Law, but the specific changes are limited to Victoria. The notice ensures that the exemption remains in effect until the specified date, thereby providing a temporary allowance for the continued operation of silage trailers under the amended conditions.

Key Provisions

The key operative sections of the Heavy Vehicle National Law Victoria - Exemption in Relation to Silage Trailers 2010 Amendment Notice (No. 2) are outlined in Sections 1 to 5. Section 1 states the purpose of the notice, which is to extend the operation of a previous Notice issued under a former corresponding law for the Heavy Vehicle National Law. Section 2 specifies the authorising provision, which is Section 23 of Schedule 1 of the Heavy Vehicle National Law. Section 3 indicates the period of operation, which commences on 1 July 2015. Section 4 specifies that this Notice amends the Exemption in Relation to Silage Trailers made under the Road Safety Act 1986 (Vic). Finally, Section 5 details the amendment to Clause 5, which extends the date from 30 June to 31 August. The obligations and requirements imposed by this Act on the parties or entities it governs include ensuring that the exemption for silage trailers is extended as per the amended Clause 5. This means that the operation of silage trailers will be permitted under the exemption until 31 August, rather than the original 30 June. The Act requires compliance with these amended provisions to maintain legal operation of silage trailers within the specified timeframe. The legislation does not explicitly detail specific offences, penalties, or consequences for breach. However, the Heavy Vehicle National Law generally imposes strict compliance requirements. Breach of these requirements can lead to civil or criminal penalties, including fines and potential disqualification from driving heavy vehicles. The specific penalties would be determined by the relevant authorities and courts, adhering to the general provisions of the Heavy Vehicle National Law. It is essential for all parties to ensure adherence to the extended exemption period to avoid any potential legal repercussions.
