Victoria Class 3 Grain Harvest Management Scheme

Mass Exemption Notice 2017 (No. 1)

 

1        Purpose

The purpose of this notice is to exempt a heavy vehicle to which it applies from stated prescribed mass requirements in Schedule 1 of the Heavy Vehicle (Mass, Dimension and Loading) National Regulation (the National Regulation), and operates in conjunction with the Victorian Grain Harvest Management Scheme (GHMS).

2        Authorising Provision

This Notice is made under s117 of the Heavy Vehicle National Law (HVNL).

3        Title

This Notice may be cited as the Victoria Class 3 Grain Harvest Management Scheme

Mass Exemption Notice 2017.

4        Commencement

The Notice commences on the date of its publication.

5        Expiry

This Notice expires five years after commencement.

6        Definitions

1)      Unless otherwise stated, words and expressions used in this notice have the same meanings as those defined in the Heavy Vehicle National Law.

2)      In this Notice:-

 

Eligible Vehicle means one of the following, that is not a Performance Based Standards vehicle;

a)      a rigid truck with two or more axles;

b)      a rigid truck (with three or more axles) towing a dog trailer with not more than four axles;

c)      a prime mover and semitrailer combination that has an overall length not exceeding 19 metres, and not more than 6 axles in total;

d)      a B-double that has an overall length not exceeding 19 metres, and not more than 7 axles in total;

e)      a B-double that has an overall length not exceeding 26 metres, and 9 axles in total.

Grain means a grain specified in the Scheme

Participating Grain Receiver means a facility that is registered as a participating receiver under the Scheme by way of a signed Participating Grain Receiver Undertaking and Signature Form lodged with VicRoads.

Victoria Grain Harvest Management Scheme (the Scheme) means the scheme of that name maintained and administered by VicRoads as described in the “Victorian Grain Harvest Management Scheme – Operating Guidelines.”

VicRoads means the Victorian state Road Authority called The Roads Corporation.

7        Application

1)      This Notice applies an eligible vehicles operating in Victoria; and

a)      is enrolled in and complies with the requirements of the Scheme; and

b)      is transporting grain from the place where the grain was loaded to a participating grain receiver.

8        Exemption from Prescribed Mass Requirements

1)      This notice exempts a vehicle to which it applies from the following general mass limits specified in Schedule 1 of the National Regulation:

a)      Section 2(1)(a)(iv);

b)      Section 2(1)(b);

c)      Section 2(2);

d)      Section 2(4);

e)      Section 4;

f)       Section 5(1) and (2); and

g)      Part 2, Table 1, 2 & 3.

9        Areas or routes

1)      A heavy vehicle operating under this notice may operate on one of the following stated networks maintained by VicRoads;

a)      for Rigid and Semi-trailers;  Grain Harvest Management Scheme Rigid Truck & Semi-Trailer Network.

b)      for B-Doubles;  Grain Harvest Management Scheme B-double Network.

10    Conditions Compliance with Scheme & Carriage of Notice

1)      An eligible vehicle operating under this notice must at all times be enrolled in and comply with the requirements or the Scheme.

2)      A copy of this Notice must be carried in the driving compartment of a heavy vehicle operating under this notice and must be produced in response to a request by a police officer or an authorised officer.

Note: This obligation may be satisfied by producing a legible electronic version of this notice.

11    Conditions Vehicle Standards and Registration

1)      An eligible vehicle operating under this notice must comply with the following requirements:

a)      have been first registered on or after 1 January 2002; and

b)      comply with Vehicle Standard (Australian Design Rule 80/00 - Emission Control for Heavy Vehicles) 2005.

12    Conditions Mass Limits

1)      The maximum loaded mass of a heavy vehicle must not exceed the lowest of the following:

a)      In the case of a combination, the GCM limit specified by the prime mover manufacturer; or

b)      In the case of a combination, the sum of the GVMs for the prime mover and the trailer or trailers it is towing; or

c)      In the case of a truck, the GVM of the vehicle; or

d)      The mass limit for the heavy vehicle set out in Table 1 of this Notice.

13    Steer axle mass exception (total mass limit) condition

A heavy vehicle that complies with the requirements of Schedule 3 of the National Regulation (Steer axle mass exception limits) may exceed the mass limit in Table 1 by 0.5 tonnes.
