Veterans' Entitlements Regulations (Amendment)

Issued by authority of the Minister for Veterans' Affairs

The Governor-General may make regulations under section 216 of the Veterans' Entitlements Act 1986 (the Act) for the purposes of the Act.

The former section 60 of the Act described the powers of the Repatriation Commission or its delegate when conducting a review under section 59 of the Act.

Subsection 60(2) described the powers of the Commission if it conducts the review itself: it may summon a person to appear at a hearing of the review, and require a person appearing at a hearing of the review to take an oath or affirmation for the purpose of giving evidence or administer an oath or affirmation to a person so appearing.

Subsection 60(3) described the powers of a delegate of the Commission who is conducting the review. These are the same as the powers of the Commission.

For the purposes of conciseness and simplicity, in the course of rewriting Part III of the Act in "plain English", the two provisions have been merged in the new subsection 57F(2).

The Regulations amend Regulation 4. Schedule 1, Form 2 is also amended. In both instances, the amendment is effected by substituting the words "subsection 57F(2)" for "subsection 60(2) or (3)" or "subsection 60(2)/subsection 60(3)" whenever occurring.

Overview

The Veterans' Entitlements Regulations (Amendment) 1991 No. 241 was enacted to streamline and simplify the regulatory framework under the Veterans' Entitlements Act 1986. This amendment aimed to modernise the legislative language, making it more accessible and easier to understand for those affected by the Act, particularly veterans and their families. Issued by authority of the Minister for Veterans' Affairs, the regulations were designed to consolidate and clarify the powers of the Repatriation Commission and its delegates in conducting reviews under the Act, ensuring that the provisions are uniformly applied and interpreted. The primary objective of these regulations is to enhance the efficiency and effectiveness of the review processes by merging the previously separate subsections 60(2) and 60(3) into the new subsection 57F(2). This consolidation not only reduces redundancy but also aligns the regulatory language more closely with the plain English rewrite of Part III of the Act, thereby facilitating better compliance and administration of veterans' entitlements.

Scope and Application

The Veterans' Entitlements Regulations (Amendment) 1991 No. 241 pertains to the amendments made to the Veterans' Entitlements Act 1986. This legislative update consolidates and simplifies the legal framework governing the powers of the Repatriation Commission and its delegates during review processes. The Act applies to the Repatriation Commission, its delegates, and any parties involved in the review process. The amendment specifically addresses the powers of the Commission and its delegates in relation to summonses and oaths during hearings, as previously outlined in section 60 of the Act. These regulations are made under the authority of the Minister for Veterans' Affairs and are applicable nationally, as they pertain to the Commonwealth’s legislative jurisdiction. The Regulations streamline the legislative text by merging the powers described in the former subsections 60(2) and 60(3) into a new subsection 57F(2), thereby enhancing clarity and efficiency. The amendments also update relevant forms and schedules to reflect these changes, ensuring consistency across all associated documentation.

Key Provisions

The Veterans' Entitlements Regulations (Amendment) 1991 No. 241 primarily revises and consolidates the regulatory framework under the Veterans' Entitlements Act 1986, focusing on updating references to align with changes made in the Act's text. Section 216 of the Act allows the Governor-General to make regulations necessary for the purposes of the Act, and these Regulations respond to such a provision. The key changes involve amending references from former section 60 of the Act to the new subsection 57F(2). Specifically, Regulation 4 and Schedule 1, Form 2 have been altered by replacing references to "subsection 60(2) or (3)" or "subsection 60(2)/subsection 60(3)" with "subsection 57F(2)" throughout the Regulations. This amendment streamlines the regulatory language, ensuring it remains consistent with the updated legislative framework. The obligations and requirements imposed by these Regulations are designed to ensure that the administrative processes under the Act are conducted smoothly and effectively. For instance, the Regulations mandate that the Repatriation Commission or its delegate has the authority to summon individuals to appear at review hearings and to require them to take an oath or affirmation to give evidence. This ensures that the review processes are formal and that the evidence presented is credible and reliable. Additionally, the Regulations maintain the powers of the Commission and its delegate to administer oaths or affirmations, which is critical for the integrity of the review and appeal processes. Breaching the provisions of the Veterans' Entitlements Act 1986 or the amended Regulations can lead to various civil and criminal consequences. While the specific penalties are not detailed in the Explanatory Statement, the Act generally provides for penalties that can include fines and, in more serious cases, imprisonment. The exact penalties would depend on the nature and severity of the breach, as well as any additional provisions or guidelines provided by the Act or relevant case law. The overarching aim is to ensure compliance with the legislative requirements to protect the rights and entitlements of veterans.
