Overview

The Veterans’ Entitlements Income Exempt Lump Sum Determination No. 3 of 2000 was enacted to address specific financial assistance requirements for participants in the Welfare Reform Pilots, which were introduced as part of the 2000-2001 Budget. This legislative instrument was made by Jeanette Ricketts, acting as Branch Head of Income Support and a delegate of the Repatriation Commission under the Veterans’ Entitlements Act 1986. The primary policy objective was to ensure that financial assistance provided to participants in the Welfare Reform Pilots, including the Mature Age Participation Pilot, Workless Families Assistance Pilot, and Tailored Assistance for the Very Long Term Unemployed Pilot, did not affect their eligibility for veterans’ entitlements. This determination aimed to clarify that payments made under these pilots are exempt lump sums for the purposes of the Veterans’ Entitlements Act 1986, thus safeguarding participants' access to veterans' benefits.

Scope and Application

The Veterans’ Entitlements Income Exempt Lump Sum Determination No. 3 of 2000 applies to individuals who are participants in the Welfare Reform Pilots, which include the Mature Age Participation Pilot, the Workless Families Assistance Pilot, and the Tailored Assistance for the Very Long Term Unemployed Pilot. These pilots are designed to offer financial assistance to various groups, such as mature-aged individuals without jobs, workless families with school-age children, and Newstart customers who have been receiving income support for five years or more, aiming to enhance their employment prospects. The determination specifies that amounts up to $500 provided to participants for the costs of services or items to help find employment or increase economic or social participation are exempt lump sums under the Veterans’ Entitlements Act 1986. Additionally, mature-age participants who complete the pilot and undertake an exit interview are eligible for an additional reimbursement of $50 for expenses incurred during their participation. This determination extends the application of the Act by clearly defining which lump sums are exempt for these specific purposes.

Key Provisions

The Veterans’ Entitlements Income Exempt Lump Sum Determination No. 3 of 2000 (section 2.1) outlines the conditions under which certain amounts received by a person are considered exempt lump sums. This determination applies to payments made under the Welfare Reform Pilots, which include the Mature Age Participation Pilot, the Workless Families Assistance Pilot, and the Tailored Assistance for the Very Long Term Unemployed Pilot (section 1.3). These payments are intended to assist participants with costs related to employment services or items that help them find employment or increase economic or social participation. Specifically, participants in these pilots may receive up to $500 for these purposes (section 2.1(3)). Additionally, participants in the Mature Age Participation Pilot may receive an extra $50 if they complete the pilot and undertake an exit interview (section 2.1(4)). Under the Veterans’ Entitlements Income Exempt Lump Sum Determination No. 3 of 2000, participants in the Welfare Reform Pilots have obligations to complete the specified pilots and, if applicable, undertake an exit interview to be eligible for the additional payments. These obligations ensure that the financial assistance provided is linked to the intended outcomes of the pilots, such as employment or increased participation in the community. It is important that participants follow through with these requirements to be eligible for the full benefits of the determination. Failure to comply with the obligations outlined in the Veterans’ Entitlements Income Exempt Lump Sum Determination No. 3 of 2000 may result in penalties or consequences. While specific penalties are not detailed in the determination, breaches of the terms could potentially lead to disqualification from receiving further benefits under the Welfare Reform Pilots or other related programs. Participants must ensure they adhere to the conditions to avoid any negative repercussions. The overarching legislation, the Veterans’ Entitlements Act 1986, may also impose further penalties or consequences for non-compliance with its provisions.
