Overview

The Veterans' Entitlements Act 1986, enacted by the Commonwealth Parliament, serves to provide various benefits and entitlements to Australian Defence Force (ADF) members and their families. This legislation addresses the specific need to clarify the nature of service rendered by ADF members during particular operations, ensuring that entitlements are accurately assessed and administered. The legislative instrument F2006B00950, dated 17 September 2001, was introduced to address the problem of categorising the service of ADF members on Operation Pollard between 17 February 1998 and 1 October 2001. This operation, taking place in a region encompassing parts of Pakistan, Afghanistan, Iran, Iraq, Jordan, Egypt, Sudan, and Kenya, was determined to constitute non-warlike service under subsection 5C(1) of the Act, thereby affecting the entitlements of the veterans involved. The policy objective of this determination is to ensure that the service rendered during this period is appropriately recognised and compensated according to the provisions of the Act.

Scope and Application

The Veterans' Entitlements Act 1986, as amended by this legislative instrument, applies specifically to members of the Australian Defence Force (ADF) who have served on Operation POLLARD. The Act targets the classification of certain military service as non-warlike, affecting the entitlements of veterans based on the nature of their service. This particular legislative instrument revokes the previous determination of 6 March 1998 concerning Operation POLLARD and establishes a new determination that service rendered by ADF members on this operation between 17 February 1998 and 1 October 2001 in a specified geographic area is to be classified as non-warlike service. This geographic area includes sea, airspace, and land north and west from a specific coordinate, encompassing parts of Pakistan, Afghanistan, Iran, Iraq, Jordan, Egypt, Sudan, and Kenya. The geographic reach of this Act is thus national, with its application confined to the specified service period and location, thereby impacting veterans' eligibility for certain benefits under the Act.

Key Provisions

The Veterans' Entitlements Act 1986 (VEA) has been amended through the Legislative Instrument F2006B00950, which addresses the determination of non-warlike service for Operation POLLARD. Section 1(a) of this legislative instrument revokes the previous determination of 6 March 1998, while section 1(b) establishes a new determination that service rendered on Operation POLLARD from 17 February 1998 to 1 October 2001 within a specified area is classified as non-warlike service (section 5C(1) of the VEA). This change in classification is crucial as it affects the entitlements of veterans who served in this operation, particularly regarding benefits related to warlike service. The obligations and requirements imposed by this Act primarily concern the definition and classification of service for the purposes of determining veterans' entitlements. Under section 5C of the VEA, the Minister for Veterans' Affairs, in this case Bruce Scott, has the authority to determine the nature of service rendered by members of the Australian Defence Force (ADF) in specific operations. For Operation POLLARD, the Minister has delineated the geographic boundaries that encompass the area of operations, extending from sea, airspace, and land north and west of a specific coordinate (5 deg 00 min S 68 deg 00 min E), covering the outer boundaries of Pakistan, Afghanistan, Iran, Iraq, Jordan, Egypt, Sudan, and Kenya. Failing to comply with the provisions set out in the legislative instrument may result in incorrect classification of service, leading to potential legal and administrative consequences. While the legislative instrument itself does not explicitly detail specific offences, penalties, or consequences for non-compliance, breaches of the VEA or related regulations could lead to disputes over entitlements. Such disputes might necessitate judicial review or other legal remedies, where the accuracy of service classification would be scrutinized. Additionally, veterans or their representatives might face challenges in obtaining the appropriate benefits if the service is incorrectly classified, potentially leading to financial or administrative repercussions. In summary, the legislative instrument revokes the previous determination and establishes new criteria for classifying service on Operation POLLARD as non-warlike service. This classification directly impacts the entitlements of veterans who served in this operation, and accurate classification is essential to ensure they receive the appropriate benefits under the VEA. The instrument outlines the geographic area of operations and empowers the Minister to make such determinations, but it does not specify penalties for non-compliance, leaving potential consequences to be addressed through existing legislative and judicial processes.
