Overview

The Broadcasting Services Act 1992 was enacted to regulate the broadcasting services industry in Australia, including television and radio, ensuring that services are provided in the public interest. This Act was introduced to address the need for a comprehensive legal framework governing broadcasting services, including the allocation of spectrum, licensing, and content regulation. The Australian Parliament enacted this legislation to ensure that broadcasting services are provided efficiently and effectively, while also protecting consumers and promoting competition. The policy objective of the Act is to provide for the regulation of broadcasting services in a manner that promotes diversity, competition, and the public interest. The Australian Broadcasting Authority, now known as the Australian Communications and Media Authority (ACMA), is responsible for administering the Act and ensuring compliance with its provisions.

Scope and Application

The legislative instrument F2009B00253 pertains to the variation of the licence area plan for television broadcasting services in the Riverland, a region in South Australia. This variation applies to the technical specifications for television services in the Riverland, specifically affecting the technical details of the transmitters located in Renmark/Loxton, Waikerie, Pinnaroo, and Lameroo. The document outlines the deletion of technical specifications for national/community television services and the addition of technical specifications for commercial television services in the Riverland area. This legislative variation was executed by the Australian Broadcasting Authority on 6 December 2001 under subsection 26(2) of the Broadcasting Services Act 1992. The legislation applies to the entities that hold or are seeking television broadcasting services licences in the specified areas, thereby affecting broadcasters operating within the Riverland region. The geographic scope is limited to the Riverland region in South Australia, and the legislation does not specify any exclusions, exemptions, or thresholds beyond the detailed technical specifications provided. The application of this legislation is further refined through the subordinate technical specifications detailed in the attachments.

Key Provisions

The key provisions of this legislative instrument (F2009B00253) involve the variation of the licence area plan (LAP) for television broadcasting services in the Riverland area, as determined under subsection 26(2) of the Broadcasting Services Act 1992. The LAP variation comprises the deletion of technical specifications for national/community television services (sections 1.11, 1.12, 1.13, and 1.14) and the addition of technical specifications for commercial television services (sections 1.20, 1.21, 1.22, and 1.23) in the T19 Riverland area. The updated Schedule reflects these changes, providing details such as the category of service, status, channel, service licence number, transmitter specification number, attachment number, and the general area served by each transmitter. The obligations and requirements imposed by this legislative instrument include the deletion and addition of technical specifications for television services in the Riverland area, as outlined in the Schedule. The Australian Broadcasting Authority must ensure that these changes comply with the Broadcasting Services Act 1992 and the Broadcasting Services (Television Content) Classification Act 1995. The Authority must also ensure that the new technical specifications for commercial television services are appropriate and do not interfere with existing services or compromise the quality of broadcast services. Failure to comply with the provisions of this legislative instrument may result in civil or criminal consequences. Under section 234 of the Broadcasting Services Act 1992, a person who contravenes the Act or any other law administered by the Australian Communications and Media Authority (ACMA) may be subject to a civil penalty of up to $50,000 for each offence. Additionally, under section 235 of the Act, a person who is found guilty of an offence against the Act may be subject to a criminal penalty of up to $500,000 for a corporation and $50,000 for an individual, or imprisonment for up to two years, or both, for each offence. It is essential for broadcasters and other relevant parties to adhere to the requirements of this legislative instrument to avoid potential penalties and legal consequences.
