Variation to Licence Area Plan –
Remote Western Australia (Radio) – 2017 (No.1)

Authority

The Australian Communications and Media Authority (the ACMA) has made the Variation to Licence Area Plan – Remote Western Australia (Radio)2017 (No. 1) (the instrument) under subsection 26(2) of the Broadcasting Services Act 1992 (the Act).

The ACMA may, by legislative instrument, vary Licence Area Plans (LAPs) under subsection 26(2) of the Act.

Purpose and operation of the instrument

The ACMA prepares LAPs under subsection 26(1) of the Act. LAPs determine the number and characteristics, including technical specifications, of broadcasting services that are to be available in particular areas of Australia with the use of the broadcasting services bands.

The Australian Broadcasting Authority made the Licence Area Plan –Remote Western Australia (Radio)August 1996 (F2005B01264) on 27 August 1996 and varied it on 21 October 2001, 22 May 2003 and 4 March 2004.

It is referred to in this explanatory statement as “the Remote Western Australia LAP.

The instrument varies the characteristics, including technical specifications, of radio broadcasting services in the Remote area of Western Australia by:

  • making spectrum available to facilitate a conversion of the 6FMS AM commercial radio broadcasting service at Exmouth to an FM transmission;
  • making spectrum available to facilitate a conversion of the 6SAT AM commercial radio broadcasting service at Paraburdoo to an FM transmission;
  • making spectrum available to facilitate a conversion of the 6SAT AM commercial radio broadcasting service at Tom Price to an FM transmission;
  • changing the technical specifications of the existing 6FMS transmitter at Telfer to improve coverage and change the transmitter site;
  • making spectrum available for FM transmitters for the commercial radio broadcasting services 6SAT and 6FMS at Morawa;
  • making spectrum available for an FM transmitter for the commercial radio broadcasting service 6FMS at Coorow and Moora;
  • changing the technical specifications of the existing transmitter for the commercial radio broadcasting service 6SAT at Exmouth to reflect the actual operating conditions and to match the proposed co-sited 6FMS Exmouth FM transmitter specifications;
  • removing, from the Remote Western Australia LAP, the technical specifications for the planned, but not operating, 6SAT Telfer transmitter and the 6FMS and 6SAT Wittenoom transmitters;
  • changing the technical specifications of a transmitter at Halls Creek for the 6PRK community radio broadcasting service to improve coverage; and
  • making spectrum available for a new community radio broadcasting service at One Arm Point (Ardyaloon) and Billiluna and determine two new licence areas for the new community radio broadcasting services.

The instrument also updates some transmitter site nominal locations, Australian Map Grid references for transmitters and advisory notes where required.

Documents incorporated by reference

The instrument incorporates the Broadcasting Services (Technical Planning) Guidelines 2007, which is a disallowable instrument made by the ACMA under section 33 of the Act. As permitted by subparagraph 14(1)(a)(ii) of the Legislation Act 2003 (the LA), that legislative instrument is incorporated as in force from time to time. The Broadcasting Services (Technical Planning) Guidelines 2007 can be accessed, free of charge, at: www.legislation.gov.au.

The instrument also incorporates areas defined by the Australian Bureau of Statistics (ABS) in its 6 August 1991, 5 August 2001 and 8 August 2006 Censuses. As permitted by paragraph 14(1)(b) of the LA, these areas are incorporated as in force at the day the instrument commenced. The areas defined in the Censuses referred to above are available, free of charge, from the ABS website at: http://www.abs.gov.au/websitedbs/censushome.nsf/home/historicaldata?opendocument&navpos=281.

Consultation

Before the instrument was made, the ACMA was satisfied that consultation was undertaken to the extent appropriate and reasonably practicable, in accordance with section 17 of the LA.

On 4 November 2016, the ACMA published a draft variation instrument together with a discussion paper on the ACMA website inviting public comment. The ACMA also wrote to the commercial radio broadcasting licensees and other broadcasting licensees in the Remote Western Australia licence areas and adjacent radio licence areas to advise them of the proposed changes to the Remote Western Australia LAP and to invite comment.

Consultation closed on 2 December 2016 and the ACMA received eight submissions which were taken into account prior to the ACMA’s making of the instrument.

Regulatory impact assessment

The Office of Best Practice Regulation (OBPR), in a guidance note titled “Carve-outs” (available here: https://www.dpmc.gov.au/resource-centre/regulation/carve-outs-guidance-note), has established a “carve-out for variations to LAPs where those variations are unlikely to have more than a minor regulatory impact (OBPR reference number 13301). A carve-out is a standing agreement between OBPR and a government agency which sets aside the requirement for a preliminary assessment to be sent to OBPR for certain types of proposed regulatory change. The ACMA has formed the opinion that the instrument falls within the terms of the carve-out with OBPR reference number 13301.

Statement of compatibility with human rights

Subsection 9(1) of the Human Rights (Parliamentary Scrutiny) Act 2011 requires the rule-maker in relation to a legislative instrument to which section 42 (disallowance) of the LA applies to cause a statement of compatibility with human rights to be prepared in respect of that legislative instrument.

Such a statement has been prepared to meet that requirement and it is set out below.

Overview of the instrument

The instrument varies, under subsection 26(2) of the Act, the Licence Area Plan – Remote Western Radio. The variations add new, or change existing, characteristics, including technical specifications, of certain radio broadcasting services in the Remote Commercial Radio Service Western Zone RA1 and the One Arm Point RA1, Balgo RA1, Beagle Bay RA1, Billiluna RA1, Broome RA1, Christmas Island RA1, Cocos Island RA1, Derby RA1, Djarindjin RA1, Fitzroy Crossing RA1, Halls Creek RA1, Jigalong RA1, Kalumburu RA1, Kiwirrkurra RA1, Kununurra RA1, Lagrange RA1, Looma RA1, Meekatharra RA1, Newman RA1, Oombulgurri RA1, Tjukurla RA1, Warmun RA1, Wingellina RA1, Yandeyarra RA1 and Yungngora RA1 community radio service licence areas. These changes are in order to improve the coverage of those services and/or to improve the accuracy of site locations.

Human rights implications

The ACMA has assessed whether the instrument is compatible with human rights, being the rights and freedoms recognised or declared by the international instruments listed in subsection 3(1) of the Human Rights (Parliamentary Scrutiny) Act 2011 as they apply to Australia.

Having considered the likely impact of the instrument and the nature of the applicable rights and freedoms, the ACMA has formed the view that the instrument does not engage any of those rights or freedoms. 

Conclusion

The instrument is compatible with human rights as it does not raise any human rights issues.

 

 

 


Attachment A

Notes to the Variation to Licence Area Plan – Remote Western Australia (Radio) – 2017 (No.1)

Section 1 Name

This section provides for the instrument to be cited as the Variation to Licence Area Plan – Remote Western Australia (Radio) – 2017 (No.1).

Section 2 Commencement

This section provides for the instrument to commence at the start of the day after it is registered on the Federal Register of Legislation. 

Section 3 Authority

This section identifies the provision of the Act that authorises the making of the instrument, namely subsection 26(2) of the Act.

Section 4 Variation

This section varies the Remote Western Australia LAP as set out in paragraphs (a) to (g).

Paragraph 4(a) renames the Remote Western Australia LAP as the “Licence Area Plan – Remote Western Australia Radio”.

Paragraph 4(b) amends the heading on the title page of the Remote Western Australia LAP so that it reads “Licence Area Plan – Remote Western Australia Radio”.

Subparagraph 4(c)(i) amends the heading on the first page of the instrument so that it reads “Licence Area Plan – Remote Western Australia Radio”.

Subparagraph 4(c)(ii) numbers of each of the paragraphs on the first page of the instrument under the heading “Licence Area Plan – Remote Western Australia Radio” as clauses (1) to (25).

Paragraph 4(d) omits clauses (1) to (25) and substitutes new clauses (1) to (28).

The new clause (1) provides that the plan is for radio broadcasting services in the Remote Western Australia area of Western Australia and is made under subsection 26(1) of the BSA.

The new clause (2) reflects the number of national, commercial and open narrowcasting radio broadcasting services in the Remote Western Australia LAP. It includes the addition of the technical specifications to facilitate the conversion of the AM services at Exmouth at Attachment 1.55, Parraburdoo at Attachment 1.115 and Tom Price at Attachment 1.120; the technical specifications for the new FM transmitters at Moora at Attachment 1.71, Morawa at Attachment 1.72 and Attachment 1.109, and Coorow at Attachment 1.48.

The new clauses (3) – (27) reflect the number of community radio broadcasting services in the Remote Western Australia LAP including the addition of the community broadcasting services at One Arm Point (Ardyaloon) at Attachment 2.2 and Billiluna at Attachment 5.2.

The new clause (28) ensures that a reference to a schedule or an attachment includes a reference to a schedule or attachment as amended from time to time and clarifies that references to other legislative instruments in the plan are taken to be references to those instruments as in force from time to time. References to other writing are taken to be references to that writing as in existence at the time the writing was incorporated into the plan.

Subparagraph 4(e)(i) removes from the Remote Western Australia LAP the heading “SCHEDULE immediately after clauses (1) to (28).

Subparagraph 4(e)(ii) removes from the Remote Western Australia LAP all the text occurring after the heading “SCHEDULE”, and before Schedule One. This material was originally included for reference only and is no longer considered relevant or necessary.

Paragraph 4(f) replaces Schedules One to Twenty Four of the Remote Western Australia LAP and substitutes the new Schedules One to Twenty Six. These Schedules set out the details of the national, commercial, community and open narrowcasting radio broadcasting services that are to be available on particular frequencies in the licence areas.

In particular, the Schedules provide the technical specification numbers for each transmitter to be used by the services in the licence areas, and specify the attachments which contain the technical specification for each of those transmitters.

Paragraph 4(g) omits all attachments and substitutes new Attachments 1.1 to 1.150, 2.1, 2.2, 3.1, 3.2, 4.1, 4.2, 5.1, 5.2, 6.1, 6.2, 7.1, 7.2, 7.3, 8.1, 8.2, 8.3, 9.1, 9.2, 10.1, 10.2, 11.1, 11.2. 12.1, 12.2, 13.1, 13.2, 14.1, 14.2, 15.1, 15.2, 16.1, 16.2-16.5, 17.1, 17.2, 18.1, 18.2, 19.1, 19.2, 20.1, 20.2, 21.1, 21.2, 22.1, 22.2, 23.1, 23.2, 24.1, 24.2, 25.1, 25.2, 26.1 and 26.2.

The new Attachment 1.1 contains the definition of the Remote Western Australia RA1 licence area in terms used by the ABS in the 2001 Census.

The new Attachments 1.2-1.44 contain the technical specifications for transmitters for national radio broadcasting services in the Remote Western Australia area. The transmitters for national services are planned to be available in Argyle, Cue, Dalwallinu, Derby, Eneabba, Fitzroy Crossing, Halls Creek, Jurien Bay, Kalbarri, Kununurra, Laverton, Leeman, Leonora, Marble Bar, Meekatharra, Mt Magnet, Mullewa, Newman, Pannawonica, Paraburdoo, Tom Price, Wyndham and Yalgoo.

The new Attachments 1.45-1.84 contain the technical specifications for the transmitters for the commercial radio broadcasting service under Service Licence number SL 010354 to be available in the Remote Commercial Radio Service Western Zone RA1 licence area. The transmitters for this commercial radio service are planned to be in Argyle, Bamboo Creek, Bellevue Mine, Coorow, Cue, Dalwallinu, Darlot, Derby, Eneabba, Exmouth, Fortnum Mine, Gairdner, Golden Grove, Goldsworthy, Halls Creek, Jameson, Jurien Bay, Kalbarri, Kununurra, Lancelin, Laverton, Leeman, Leinster, Leonora, Meekatharra, Moora, Morawa, Mt Magnet, Newman, Nullagine, Pannawonica, Paraburdoo, Perenjori, Shay Gap, Telfer, Tjirrkarli, Tom Price, Warburton and Yiyili. Attachment 1.54 provides that the transmitter with specification number TS10001798 ceases to be available for service licence number SL10354 28 days after the first day on which the service provided under service licence number SL10354 is transmitted by transmitter TS1136651.

The new Attachments 1.85-1.122 contain the technical specifications for the transmitters for the commercial radio broadcasting service under Service Licence number SL 10018 to be available in the Remote Commercial Radio Service Western Zone RA1 licence area. The transmitters for this commercial radio service are planned to be in Argyle, Bamboo Creek, Bellevue Mine, Cue, Dalwallinu, Darlot, Derby, Eneabba, Exmouth, Fortnum Mine, Gairdner, Golden Grove, Goldsworthy, Halls Creek, Jameson, Jurien Bay, Kalbarri, Kununurra, Lancelin, Laverton, Leeman, Leinster, Leonora, Meekatharra, Morawa, Mt Magnet, Newman, Nullagine, Pannawonica, Paraburdoo, Perenjori, Shay Gap, Tjirrkarli, Tom Price, Warburton and Yiyili. Attachment 1.114 provides that the transmitter with specification number TS10001793 ceases to be available for service licence number SL10018 28 days after the first day on which the service provided under service licence number SL10018 is transmitted by transmitter TS10000682. Attachment 1.119 provides that the transmitter with specification number TS10001794 ceases to be available for service licence number SL10018 28 days after the first day on which the service provided under service licence number SL10018 is transmitted by transmitter TS1136658.

The new Attachment 1.123 contains the technical specifications for the transmitter for the open narrowcasting radio broadcasting service to be available at Beagle Bay in the Remote Commercial Radio Service Western Zone RA1 licence area.

The new Attachment 1.124 contains the technical specifications for the transmitter for the open narrowcasting radio broadcasting service to be available at Carnamah in the Remote Commercial Radio Service Western Zone RA1 licence area.

The new Attachment 1.125 contains the technical specifications for the transmitter for the open narrowcasting radio broadcasting service to be available at Coorow in the Remote Commercial Radio Service Western Zone RA1 licence area.

The new Attachment 1.126 contains the technical specifications for the transmitter for the open narrowcasting radio broadcasting service to be available at Cue in the Remote Commercial Radio Service Western Zone RA1 licence area.

The new Attachment 21.1 contains the definition of the Oombulgurri RA1 licence area in terms used by the ABS in the 1991 Census.

The new Attachment 21.2 contains the technical specifications for the transmitter for the community radio broadcasting service under Service Licence number SL 10026 to be available in Oombulgurri in the Oombulgurri RA1 licence area.

The new Attachment 22.1 contains the definition of the Tjukurla RA1 licence area in terms used by the ABS in the 1991 Census.

The new Attachment 22.2 contains the technical specifications for the transmitter for the community radio broadcasting service under Service Licence number SL 10027 to be available in Tjukurla in the Tjukurla RA1 licence area.

The new Attachment 23.1 contains the definition of the Warmun RA1 licence area in terms used by the ABS in the 1991 Census.

The new Attachment 23.2 contains the technical specifications for the transmitter for the community radio broadcasting service under Service Licence number SL 10028 to be available in Warmun in the Warmun RA1 licence area.

The new Attachment 24.1 contains the definition of the Wingellina RA1 licence area in terms used by the ABS in the 1991 Census.

The new Attachment 24.2 contains the technical specifications for the transmitter for the community radio broadcasting service under Service Licence number SL 10029 to be available in Wingellina in the Wingellina RA1 licence area.

The new Attachment 25.1 contains the definition of the Yandeyarra RA1 licence area in terms used by the ABS in the 1991 Census.

The new Attachment 25.2 contains the technical specifications for the transmitter for the community radio broadcasting service under Service Licence number SL 10038 to be available in Yandeyarra in the Yandeyarra RA1 licence area.

The new Attachment 26.1 contains the definition of the Yungngora RA1 licence area in terms used by the ABS in the 1991 Census.

The new Attachment 26.2 contains the technical specifications for the transmitter for the community radio broadcasting service under Service Licence number SL 10030 to be available in Yungngora in the Yungngora RA1 licence area.

Minor amendments to the descriptions of nominal locations of transmitter sites, to Australian Map Grid references and advisory notes have been made in some of the Attachments. In each case the information has been updated to better reflect current operations or for ease of reference only. These amendments do not signify a change to the planned performance of the relevant transmitter.
