VARIATION OF PIPELINE LICENCE WA-5-PL

 

I, JOANNE JENNIFER BELL, Delegate of the National Offshore Petroleum Titles Administrator, on behalf of the Commonwealth–Western Australia Offshore Petroleum Joint Authority hereby vary Pipeline Licence WA-5-PL as set out below.  

 

  1. The First Schedule of the Licence is varied by deleting the words:

 

The route of the pipeline shall be as described in the table below, from and including the boundary of Pipeline Licence WA-21-PL and WA-5-PL at the western end of the East Spar manifold at or about 7,707,290.78mN, 290,101.15mE to the pipeline licence boundary of TPL-12 at or about 7,714,306.54mN, 330,042.88mE along a line no point of which shall be more than 125 metres from the proposed pipeline route as shown in the drawing attached to the Licence as Annexure ‘A’.  The coordinates given above are relative to UTM zone 50, with Central Meridian 117 deg E based on Geodetic Datum of Australia (GDA94).

2.      The Second Schedule of Part 1 Specifications of the Licence is varied by:

 

a)      Deleting from Section (A) Design subsection (n) the words:

 

67 (manifold), 66 (subsea pipeline)

 

And replacing with:

 

“66”

 

b)     Deleting from Section (A) Design subsection (p) the words:

 

“Substance to be conveyed: Corrosion inhibited 3-phase wellstream

Maximum CO2 content (%Vol): 2.0 Mole %

Maximum water content (mg/m3): 7,000

Maximum hydrogen sulphide (mg/m3): 2

Maximum sulphur (mg/m3): 2”

 

And replacing with:

c)      Deleting from Section (A) Design subsection (w) the words:

d)     Deleting from Section (A) Design subsection (y) the words:

 

“Subsea:
Pipeline licence includes East Spar Manifold. All manifold piping and valves manufactured from corrosion resistant alloy (duplex) suitable for the produced fluids.
Manifold piping sized to match the pipeline and designed in accordance with API 6A. Piping and valves are interconnected by means of flanges or hubs/clamps.
Support structure designed in accordance with API RP 2A. Free standing and supported by mudmats.

3.      The WA-5-PL Pipeline Route Map at ‘Annexure A’ of the Licence is deleted and replaced with the map at Annexure A of this instrument. 

 

The variation takes effect on the day on which a notice of the variation is published in the Commonwealth Government Gazette.

Overview

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 was enacted to provide a regulatory framework for the exploration, development, and production of offshore petroleum and greenhouse gas storage within Australia's jurisdiction. This Act aims to balance the exploitation of offshore resources with environmental protection and safety, ensuring that activities are conducted in a manner that minimises risks to human health, safety, and the environment. The Act was introduced to address the need for a comprehensive legal structure that governs offshore petroleum operations and greenhouse gas storage, promoting sustainable development while protecting Australia's marine environment. The Act is administered by the Commonwealth of Australia, with the National Offshore Petroleum Titles Administrator serving as the key regulatory body. The policy objective of the Act is to facilitate the efficient and responsible use of offshore resources while safeguarding the environment and ensuring public safety. This legislation empowers the Commonwealth-Western Australia Offshore Petroleum Joint Authority to make variations to pipeline licences, as demonstrated in the variation of Pipeline Licence WA-5-PL. This specific variation, made by Joanne Jennifer Bell, the Delegate of the National Offshore Petroleum Titles Administrator, involves modifying the pipeline route and certain design specifications to align with updated operational requirements. The geographic reach of the Act encompasses federal waters, state waters, and the Australian Exclusive Economic Zone, ensuring comprehensive regulation across these areas. The Act provides for variations to existing pipeline licences, such as the variation of Pipeline Licence WA-5-PL detailed in the instrument, which specifies changes to the pipeline route, design specifications, and operational parameters. The variation extends to the geographic scope defined by the new coordinates and the specific exclusions and modifications to the pipeline's design and operational conditions. This variation, which takes effect upon publication in the Commonwealth Government Gazette, is made under the authority granted by the Offshore Petroleum and Greenhouse Gas Storage Act 2006.

Under section 708 of the Offshore Petroleum and Greenhouse Gas Storage Act 2006, any person who contravenes a provision of a pipeline licence can be subject to penalties. For corporations, the maximum penalty is $1.65 million, while for individuals, the maximum penalty is $330,000. Additionally, ongoing non-compliance may lead to the suspension or revocation of the pipeline licence, further compounding the legal and operational repercussions for the licence holder.
