OFFSHORE PETROLEUM JOINT AUTHORITY

Annexure A

Overview

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 was enacted to provide a framework for the regulation of offshore petroleum activities and greenhouse gas storage in Australia, addressing the need for comprehensive regulation of offshore petroleum and gas operations, including environmental protection and resource management. The Act was introduced by the Commonwealth Parliament with the policy objective of ensuring that offshore petroleum activities are conducted in a manner that is safe, environmentally responsible, and economically efficient. This legislation empowers the National Offshore Petroleum Titles Administrator to grant licences and impose conditions on activities related to offshore petroleum and greenhouse gas storage, thereby facilitating the orderly development of Australia’s offshore energy resources while safeguarding public and environmental interests. The Act also establishes mechanisms for the joint administration of offshore petroleum resources between the Commonwealth and the states, in this case Western Australia.

Scope and Application

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 (Act) applies to the construction and operation of pipelines for the conveyance of petroleum within the offshore area of Western Australia. This legislation governs the activities of entities involved in the offshore petroleum industry, ensuring that these operations are conducted in a manner that is safe, environmentally responsible, and in compliance with the regulations and conditions specified by the Commonwealth–Western Australia Offshore Petroleum Joint Authority. The Act provides the framework for the regulation of offshore petroleum activities, including the issuance and variation of pipeline licenses, as demonstrated by the variation of Pipeline Licence WA-5-PL. The variation affects the licensee's obligations, the scope of the licence, and the technical specifications and conditions under which the pipeline must be constructed and operated. Geographic reach of the Act is limited to the offshore area of Western Australia, thereby delineating its jurisdictional boundaries. Subordinate instruments, such as regulations and specific licence conditions, further extend and detail the application of the Act, ensuring comprehensive governance of offshore petroleum activities in the region.

Key Provisions

The main operative sections of the Offshore Petroleum and Greenhouse Gas Storage Act 2006, as varied by the Gazette C2017G01071, include changes to the Pipeline Licence WA-5-PL, dated 19 March 1996. Specifically, the text of the Licence (section 1) is altered to redefine the pipeline licence's scope, conditions, and compliance requirements. The interpretation section (section 2) is modified to clarify definitions of "the Act" and "the Regulations". The First Schedule (section 3) updates the pipeline route's coordinates and boundaries, while the Second Schedule (section 4) revises the pipeline's specifications and conditions. Lastly, section 5 streamlines the conditions of the licence, keeping only the sections related to the pipeline route and seabed survey, while section 6 replaces the existing map with a new one. The obligations imposed on the parties governed by this Act include strict adherence to the modified pipeline licence conditions, specifications, and regulations. The licensee must ensure that the pipeline is constructed and operated according to the newly specified design, construction, size, capacity, and route. Furthermore, the licensee must comply with all provisions of the Offshore Petroleum and Greenhouse Gas Storage Act 2006 and any regulations made under the Act. Any changes to the pipeline's operations must also adhere to the Act and the Regulations, as amended from time to time. The Gazette C2017G01071 imposes potential civil and criminal consequences for breaches of the Act or the licence conditions. Violations of the Act or the Regulations may result in enforcement actions, including fines and penalties. The maximum penalties for offences under the Offshore Petroleum and Greenhouse Gas Storage Act 2006 can be substantial, depending on the severity of the breach. In cases of serious non-compliance, the licensee may face criminal charges, which could lead to imprisonment. It is crucial for the licensee to ensure full compliance with the Act and the Regulations to avoid these potential consequences.
