Overview

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 was enacted to provide a legislative framework for the regulation of offshore petroleum and greenhouse gas storage activities. This legislation was introduced to address the need for a comprehensive legal structure governing offshore petroleum operations and the storage of greenhouse gases. The Act was enacted by the Parliament of Australia, aiming to ensure that offshore petroleum activities are conducted in a safe, environmentally responsible, and economically efficient manner. The policy objective of the Act is to balance the exploitation of offshore resources with the protection of the marine environment and the equitable sharing of benefits among stakeholders. The provided gazette notice concerns the variation of Pipeline Licence WA-24-PL (GWF-1), which involves changes to the pipeline route, specifications, and design parameters. The variation is made under the authority of the Offshore Petroleum and Greenhouse Gas Storage Act 2006 by the National Offshore Petroleum Titles Administrator on behalf of the Commonwealth-Western Australia Offshore Petroleum Joint Authority. This change to the pipeline licence ensures compliance with updated design and construction standards, including adherence to specific offshore pipeline and flowline standards, as well as updated corrosion protection measures. The modifications are designed to maintain the integrity and safety of the pipeline system while facilitating efficient offshore petroleum operations.

Scope and Application

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 applies to the regulation of offshore petroleum and greenhouse gas storage activities in Australian waters. This legislation governs the licensing, environmental management, and operational standards for offshore petroleum and greenhouse gas storage activities, including the construction and maintenance of pipelines. Specifically, the Act allows for the variation of pipeline licences to ensure compliance with updated technical and safety standards. In this instance, the Act is used to vary Pipeline Licence WA-24-PL for the Greater Western Flank Phase 1 (GWF-1) pipeline. The variation, which becomes effective upon publication in the Commonwealth Government Gazette, involves the National Offshore Petroleum Titles Administrator altering the pipeline route, specifications, and technical standards for the pipeline owned by Woodside Energy Ltd., BP Developments Australia Pty. Ltd., Chevron Australia Pty Ltd, BHP Petroleum (North West Shelf) Pty Ltd, Shell Australia Pty Ltd, and Japan Australia LNG (MIMI) Pty. Ltd. The changes include a revised pipeline route, updated specifications for design and construction, and modifications to the technical parameters and materials used. This variation extends the application of the Act by imposing new conditions on the pipeline licence, thereby ensuring the pipeline meets the latest safety and operational standards.

Key Provisions

The primary sections of the Offshore Petroleum and Greenhouse Gas Storage Act 2006 (the Act) that are pertinent to this variation are Sections 226 and 708. Section 226 allows the National Offshore Petroleum Titles Administrator to vary a pipeline licence, while Section 708 provides the mechanism for the Administrator to issue such variations by way of a notice in the Commonwealth Government Gazette. This variation modifies the Pipeline Licence WA-24-PL by altering the pipeline route, specifications, and other operational parameters as specified in the notice. The Act imposes several obligations on the parties involved. Firstly, the registered titleholders, which include Woodside Energy Ltd., BP Developments Australia Pty. Ltd., Chevron Australia Pty Ltd, BHP Petroleum (North West Shelf) Pty Ltd, Shell Australia Pty Ltd, and Japan Australia LNG (MIMI) Pty. Ltd, must ensure that the pipeline and associated flowlines are designed and constructed according to the specified standards and parameters. This includes adhering to the Offshore Standard DNV-OS-F101 and the relevant API standards for flexible pipes. Secondly, the titleholders must ensure that the pipeline and flowlines are made from materials that meet the specified standards, such as 316L Stainless Steel and an external layer of carbon steel. Additionally, the titleholders must implement an anti-corrosion coating and a sacrificial anode cathodic protection system to protect the pipeline and flowlines from external corrosion. Failure to comply with the provisions of the Act or the terms of the licence variation can result in both civil and criminal consequences. Civil penalties for non-compliance can include fines, while criminal penalties may include imprisonment. The specific penalties are determined by the relevant courts based on the severity and nature of the breach. The Act does not specify maximum penalties in this context, but general provisions within the Act and related legislation outline the potential penalties, which can vary widely depending on the circumstances of the offence. The variation of the Pipeline Licence WA-24-PL under the Offshore Petroleum and Greenhouse Gas Storage Act 2006, as executed by the National Offshore Petroleum Titles Administrator, introduces detailed modifications to the pipeline's route, specifications, and operational parameters. These changes are designed to ensure compliance with stringent design and construction standards, material specifications, and corrosion protection measures. The obligations imposed on the registered titleholders are comprehensive, encompassing adherence to specific technical standards, material requirements, and protective measures. Any breach of these obligations could lead to significant civil and criminal repercussions, although the exact penalties are not specified in the Act but would be determined by applicable law.
