I, STEVEN ROBERT TAYLOR, the Delegate of the National Offshore Petroleum Titles Administrator, on behalf of the Commonwealth-Victoria Offshore Petroleum Joint Authority hereby vary Pipeline Licence VIC/PL26, dated 14 October 1996 (the Licence), for which:
Esso Australia Resources Pty Ltd
(ACN 091 829 819)
Woodside Energy (Bass Strait) Pty Ltd
(ACN 004 228 004)
are the registered titleholders, as set out below.
The variation takes effect on the day on which this notice of variation is published in the Australian Government Gazette.

SECOND SCHEDULE
SPECIFICATIONS
- Design
- The pipeline design is based on the following parameters –
- one 250 mm nominal diameter pipeline for the conveyance of gaseous and liquid hydrocarbons and water;
- flow rate of 7500 sm3/d (0.047 MMbbl/d) of liquid hydrocarbons and water and 1.80 MMm3/d (63.57 MMscf/d) of gaseous hydrocarbons;
- an internal design pressure of 24,800 kPag;
- a design temperature of 70⁰C;
- a pipeline length of 6.3 km;
- contained inside an unburied carrier pipeline.
- The carrier pipeline design is based on the following parameters –
- one 355.6 mm O.D. with 6.4 mm W.T. pipeline.
- Materials of Construction
- Steel Pipe
The line pipe shall be in accordance with the requirements of the American Petroleum Institute Specification – API Spec 5L, Nov 1992, 40th Edition for Grade X65 seamless pipe and Esso Australia Limited supplemental pipe specification accompanying the pipeline licence application, and the pipeline shall have the dimensions 273.1 mm O.D. with 14.3 mm W.T.
The carrier pipe shall be in accordance with the requirements of the American Petroleum Institute Specification – API Spec 5L, Nov 1992 40th Edition for Grade X52 electric resistance welded pipe and shall have the dimensions 355.6 mm O.D. with 6.4 mm W.T.
- Protective Coating
The line pipe shall be coated with 1 mm Yellow Jacket and 24 mm of Polyurethane foam in accordance with the Esso Australia Limited Protective Coatings Specifications accompanying the pipeline licence application.
- Carrier Pipe
The carrier pipe shall be protected by a coating of Fusion Bonded Epoxy 500 Microns thick and weight coated with 25 mm of concrete in accordance with the Esso Australia Limited Coating Specifications accompanying the pipeline licence application.
Attachment A
Overview
The Offshore Petroleum and Greenhouse Gas Storage Act 2006 was enacted to provide a comprehensive legal framework for the regulation of offshore petroleum activities and greenhouse gas storage in Australia. The Act aims to ensure the environmentally sustainable development of Australia's offshore petroleum resources and the safe and environmentally sound management of greenhouse gas storage. It was introduced to address the need for a robust legislative regime to govern the exploration, production, and storage of offshore petroleum and greenhouse gases, including the regulation of pipeline infrastructure. The Act was passed by the Parliament of Australia, reflecting the national policy objective to balance economic development with environmental protection in the management of offshore resources. Under this Act, variations to existing pipeline licenses, such as the variation of Pipeline Licence VIC/PL26 described in the Gazette, are authorised to ensure the continued safe and effective operation of offshore infrastructure.
Scope and Application
The Offshore Petroleum and Greenhouse Gas Storage Act 2006 applies to the variation of the Pipeline Licence VIC/PL26, which is governed by the Commonwealth of Australia and pertains to the activities of Esso Australia Resources Pty Ltd and Woodside Energy (Bass Strait) Pty Ltd. This variation specifically modifies the route of the pipeline from the subsea cut location near the Bream B platform to the subsea cut location near the Bream A platform, as detailed in the First Schedule of the Licence. The Act extends its jurisdictional reach across the Commonwealth, ensuring that the modification adheres to the regulatory framework established for offshore petroleum activities. The Second Schedule of the Licence, detailing the specifications such as the pipeline design, materials of construction, and protective coatings, remains unchanged. This variation does not introduce new exclusions, exemptions, or thresholds, and its application is confined to the specified pipeline licence without extending to other activities or entities beyond those named.

This section mandates the deletion of the existing route description and its replacement with a new route description, which is detailed in the First Schedule of the variation. The registered titleholders, Esso Australia Resources Pty Ltd and Woodside Energy (Bass Strait) Pty Ltd, must adhere to the updated route coordinates and the design specifications detailed in the First and Second Schedules. This includes the construction of the pipeline according to the specified dimensions, materials, and protective coatings, as outlined in the Second Schedule.
Breach of the conditions stipulated in this variation could result in legal consequences. The Offshore Petroleum and Greenhouse Gas Storage Act 2006 provides for penalties for non-compliance with licence conditions. The maximum penalties for offences under this Act include fines of up to $1,260,000 for corporations and up to $252,000 for individuals, as per section 708(1). Additionally, any failure to comply with the specified route and design parameters may lead to the suspension or revocation of the pipeline licence, further impacting the operations of the titleholders. The enforcement of these penalties is intended to ensure that the pipeline operations are conducted in a manner that complies with the legislative requirements, thereby safeguarding environmental and operational standards.
