Overview
The Offshore Petroleum and Greenhouse Gas Storage Act 2006 was enacted by the Parliament of the Commonwealth of Australia to provide a legislative framework for the regulation of offshore petroleum activities and greenhouse gas storage within Australia's jurisdiction. This legislation was introduced to address the need for comprehensive regulation of offshore petroleum operations to ensure environmental protection, safety, and efficient resource management. The Act outlines the processes for licensing, environmental protection, and the management of risks associated with offshore petroleum activities, aiming to balance the economic benefits of such activities with the need to safeguard the environment and public safety.
The National Offshore Petroleum Titles Administrator, on behalf of the Commonwealth–Victoria Offshore Petroleum Joint Authority, has exercised their powers under the Act to vary the Pipeline Licence VIC/PL1. This variation, which takes effect upon publication in the Commonwealth Government Gazette, involves modifying the route of the pipeline to ensure compliance with current safety and environmental standards. The policy objective behind such variations is to maintain the integrity and safety of offshore infrastructure while adapting to operational requirements and environmental considerations.
Scope and Application
The Offshore Petroleum and Greenhouse Gas Storage Act 2006 applies to the licensing and regulation of offshore petroleum activities and greenhouse gas storage within Australian waters, including the modification of existing pipeline licences. This Act extends its jurisdiction to cover Commonwealth waters, thus including any operations and activities associated with offshore pipelines that traverse these waters. The Act applies to entities such as Esso Australia Resources Pty Ltd and BHP Petroleum (Bass Strait) Pty Ltd, who hold titles under the Act. The variation of Pipeline Licence VIC/PL1 under this Act specifies the new route and operational parameters for the pipeline, reflecting adjustments to its path as determined by the National Offshore Petroleum Titles Administrator on behalf of the Commonwealth–Victoria Offshore Petroleum Joint Authority. This variation is effective from the date of its publication in the Commonwealth Government Gazette, thus incorporating any necessary changes to the pipeline's operational details as mandated by the Act. The Act does not specify exclusions or thresholds in this instance but allows for the extension or restriction of its application through subordinate instruments.
Key Provisions
The Offshore Petroleum and Greenhouse Gas Storage Act 2006 (the Act) provides the legislative framework for regulating activities related to offshore petroleum and greenhouse gas storage in Australia. Section 226 of the Act empowers the National Offshore Petroleum Titles Administrator to vary the terms of a pipeline licence as necessary. In this case, the Administrator has exercised this power to vary Pipeline Licence VIC/PL1 (the Licence) for the offshore pipeline from the Barracouta platform to the shore. The variation, detailed in the Gazette, is effective from the date of publication in the Commonwealth Government Gazette.
The variation of the pipeline licence under Section 708 of the Act involves altering the description of the pipeline's route. The First Schedule of the Licence is amended to specify a new route for the steel pipeline, starting at the Barracouta Last Valve Off and terminating at the boundary of Commonwealth offshore waters at the 3 nautical mile limit. This revised route includes several deflection points and crossings with other infrastructure such as VIC/SL7 and VIC/PL23. Additionally, the route for the West Barracouta flexible pipeline is described in detail, outlining the tie-in flange at the Flowline End Manifold and the hot tap location on the steel pipeline within the 500 m petroleum safety zone of the Barracouta platform.
The Act imposes several obligations on the registered titleholders of the Licence, Esso Australia Resources Pty Ltd and BHP Petroleum (Bass Strait) Pty Ltd. These include ensuring that the pipeline operations are conducted in accordance with the specified routes and safety standards. The titleholders must also comply with any environmental and safety regulations relevant to offshore petroleum activities. Additionally, they are required to maintain records of the pipeline's operation and make these available for inspection by authorised officers under the Act.
Failure to comply with the provisions of the Act or the varied terms of the Licence can result in significant consequences. The Act provides for both civil and criminal penalties for breaches. Civil penalties may include fines up to a specified amount, depending on the nature and severity of the breach. Criminal offences can lead to imprisonment, with maximum penalties also defined in the Act. Additionally, breaches may result in the suspension or revocation of the Licence, which could halt pipeline operations until compliance is achieved.
