ATTACHMENT 1 – Julimar-Brunello Petroleum Pipeline RouTE

Overview

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 was enacted to provide a legislative framework for the regulation of offshore petroleum activities and greenhouse gas storage in Australia. This Act was introduced to address the need for effective management and regulation of offshore petroleum resources and to ensure environmentally sustainable practices. The Act was passed by the Commonwealth Parliament, aiming to balance the economic benefits of offshore petroleum activities with the need to protect the marine environment. The policy objective of the Act is to facilitate the responsible and efficient development of Australia's offshore petroleum resources while minimising environmental impact and ensuring public safety. This particular legislation involves a variation to Petroleum Pipeline Licence WA-26-PL, which allows for changes to the pipeline's description, route, and specifications. The variation was made by the National Offshore Petroleum Titles Administrator on behalf of the Commonwealth-Western Australia Offshore Petroleum Joint Authority. The changes include modifications to the pipeline route, the replacement of the Julimar-Brunello Petroleum Pipeline Route Map, and adjustments to the operating temperature range within the Schedule of Specifications. These amendments aim to ensure that the pipeline operations remain within the regulatory framework established by the Act, reflecting updated technical and safety requirements.

Scope and Application

The Offshore Petroleum and Greenhouse Gas Storage Act 2006 applies to entities involved in offshore petroleum activities, including petroleum pipeline operations within the offshore area of Western Australia. The Act, a Commonwealth legislation, governs the licensing and regulation of offshore petroleum activities and greenhouse gas storage in Australia. This specific gazette notice concerns the variation of Petroleum Pipeline Licence WA-26-PL, which pertains to the construction and operation of a petroleum pipeline system. The licence is held by Woodside Energy Julimar Pty Ltd and Kufpec Australia (Julimar) Pty Ltd. The amended licence modifies the description of the pipeline, its route, and the schedule of specifications, including adjustments to the operating temperature range. This variation does not include any exclusions or exemptions, and the changes are effective from the day the notice appears in the Australian Government Gazette. The Act allows for further regulation and specification through subordinate instruments, which may include detailed operational standards, safety measures, and environmental considerations pertinent to offshore petroleum pipeline activities.

Key Provisions

Section 708 of the Offshore Petroleum and Greenhouse Gas Storage Act 2006 provides for the variation of the Petroleum Pipeline Licence WA-26-PL, held by Woodside Energy Julimar Pty Ltd and Kufpec Australia (Julimar) Pty Ltd. This variation alters the description of the pipeline licence, the route of the pipeline, and the schedule of specifications. Specifically, the new description replaces the old one, defining the licence as a pipeline system for the conveyance of petroleum from the BRUA Manifold through the Brunello Production Pipeline and the Julimar Production Pipeline. The route of the pipeline is updated with new coordinates for the BRUA Manifold, BRUA Crossover Manifold, and various displacement initiators along the Brunello and Julimar pipelines. The schedule of specifications is revised to include a new operating temperature range, setting a maximum of 133°C for pipelines and 100°C for facilities/stations, and a minimum of -20°C for both pipelines and facilities/stations. The Act imposes several obligations on the licensees, including adherence to the new description and route of the pipeline as specified. The licensees must also comply with the updated schedule of specifications, ensuring that the pipeline operates within the new temperature parameters. Additionally, the licensees are required to maintain the pipeline in a safe and environmentally responsible manner, consistent with the conditions of their licence and applicable laws. They must also submit any necessary reports or documentation to the relevant authorities as stipulated in the licence terms. Failure to comply with the provisions of the Act or the terms of the licence may result in enforcement actions. Potential civil consequences include fines and orders for remediation. Under Section 708, specific penalties are not detailed in the text, but generally, breaches of the Offshore Petroleum and Greenhouse Gas Storage Act 2006 can lead to significant financial penalties. Criminal penalties may also apply for more severe breaches, potentially resulting in imprisonment. The exact penalties depend on the nature and severity of the breach, as well as any relevant case law or statutory provisions.
