Overview
The Financial Sector (Collection of Data) Act 2001, enacted by the Australian Parliament, was introduced to address the need for the systematic collection and regulation of financial data within the sector, ensuring transparency and accountability among financial entities. This Act empowers the Australian Prudential Regulation Authority (APRA) to maintain a Register of Entities and a list of registered entities, facilitating the regulation and oversight of financial institutions. The policy objective behind this legislation is to enhance the stability and integrity of the financial sector by ensuring that APRA has up-to-date and accurate information on registered entities, thereby enabling it to perform its regulatory functions effectively. The Variation of List of Names and Categories of Registered Entities, issued under the authority of this Act, reflects ongoing updates to the list of registered entities, including the addition of new entities such as Wingate Group Holdings Pty. Ltd., as mandated by the legislative framework.
Scope and Application
The Financial Sector (Collection of Data) Act 2001 applies to entities within the financial sector that are required to provide data to the Australian Prudential Regulation Authority (APRA). This Act facilitates the collection, analysis, and dissemination of data from these entities to ensure the stability and efficiency of the financial sector. The Act specifically mandates APRA to maintain a Register of Entities, which includes details of all entities that are subject to the Act, and a List of Names of registered entities. This legislation applies nationally, covering all financial sector entities within Australia. The Act's application is extended or restricted through subordinate instruments, allowing for the amendment of the list of registered entities as necessary. The Act does not specify any exclusions or exemptions, indicating that it broadly encompasses all entities within its scope unless otherwise defined by the Act or subsequent legislation. The inclusion of Wingate Group Holdings Pty. Ltd. in the list of registered entities is a direct application of this Act, reflecting its comprehensive reach across the financial sector.
Key Provisions
The main operative sections of this legislation, specifically subsection 11(2) of the Financial Sector (Collection of Data) Act 2001, empower a delegate of the Australian Prudential Regulation Authority (APRA) to vary the list of registered entities by adding the names of corporations that meet the criteria for registration. This action is taken pursuant to the authority granted under paragraph 10(a) of the Act, which requires APRA to include the names of corporations and related particulars in the Register of Entities. The amendment to the list of registered entities is formalised under this subsection to ensure that all relevant entities are accurately documented and recognised within the regulatory framework.
The obligations and requirements imposed by this legislation on APRA include maintaining an up-to-date Register of Entities and a corresponding list of names of registered entities. Under section 11 of the Act, APRA is mandated to include the names of any entities that meet the criteria for registration, as specified in section 7. This necessitates that APRA ensures all registrable corporations, such as Wingate Group Holdings Pty. Ltd., are correctly identified and added to the register and list. Additionally, the legislation requires that the delegate of APRA, in this case John Hotham, exercise the authority granted under subsection 11(2) to make the necessary amendments to the list to reflect these changes accurately.
The legislation does not explicitly outline offences, penalties, or civil/criminal consequences for breaches of its provisions. However, it is implied that failure to comply with the requirements to maintain accurate records and lists within the regulatory framework could lead to legal repercussions. Such consequences might include regulatory action, fines, or other penalties as determined by the relevant authorities under broader financial sector legislation. The precise penalties would depend on the nature and severity of the breach, as well as any additional provisions within the Financial Sector (Collection of Data) Act 2001 or other applicable laws.
