APRA means the Australian Prudential Regulation Authority.

Overview

The Financial Sector (Collection of Data) Act 2001, enacted by the Parliament of Australia, was introduced to facilitate the collection of financial data from entities within the financial sector, thereby improving regulatory oversight and financial stability. This Act established a framework for the Australian Prudential Regulation Authority (APRA) to maintain a register of entities and a list of their names, ensuring that relevant information is systematically collected and updated. The purpose of this particular legislative instrument, which varies the list of names and categories of registered entities, is to reflect the changes in the entities that are subject to APRA's data collection regime, thus maintaining the accuracy and currency of the register. By ensuring the list is up-to-date, the Act supports APRA's objective of effective supervision and regulation of financial institutions.

Scope and Application

The Financial Sector (Collection of Data) Act 2001, as amended, provides the legal framework for the Australian Prudential Regulation Authority (APRA) to maintain a Register of Entities and a List of Names and Categories of Registered Entities. The Act applies to entities within the financial sector, which includes authorised deposit-taking institutions, authorised market operators, and certain other entities specified under the Act. These entities are mandated to provide data to APRA to ensure the stability and integrity of the financial system. The geographic reach of the Act is national, as it applies to entities operating within Australia. The Act does not specify exclusions or exemptions, except for those entities that do not meet the criteria for registration. The application of the Act can be extended or restricted through subordinate instruments, allowing APRA to adapt the register and list to evolving industry standards and regulatory requirements. The recent variation of the list by adding the name of Wingate Finco 2 Pty Ltd demonstrates APRA's ongoing commitment to ensuring the comprehensive and accurate maintenance of the register, thereby fulfilling its statutory obligations under the Act.

Key Provisions

The primary operative sections of this legislation pertain to the updating of the list of registered entities under the Financial Sector (Collection of Data) Act 2001. Specifically, section 8 outlines the maintenance of a Register of Entities by the Australian Prudential Regulation Authority (APRA). Section 11 details the keeping of a list of names of these registered entities. The addition of Wingate Finco 2 Pty Ltd to this list, as mentioned in section 7, is based on its classification as a registrable corporation under the Act. The authority to add the corporation’s name to the register is granted under section 10(a), and its subsequent status as a registered entity is confirmed under section 5(3). The Act imposes certain obligations and requirements on APRA, primarily ensuring that the Register of Entities and the list of registered entities' names are kept up to date and accurate. APRA must perform its duties diligently, verifying the registrable status of corporations and updating the list accordingly. This includes the obligation to add the names of new registrable corporations, as specified in section 11, and ensuring that all information regarding these entities is correctly documented and maintained within the register. In terms of consequences for breaches or non-compliance, the legislation does not explicitly outline offences, penalties, or specific civil or criminal consequences for failing to update the list of registered entities. However, given the regulatory nature of the Act and the critical role of APRA in financial sector oversight, non-compliance could potentially lead to broader regulatory scrutiny and enforcement actions by APRA. Although the specific penalties are not stated in this variation notice, any failure to adhere to the requirements could result in sanctions that align with other provisions within the Financial Sector (Collection of Data) Act 2001 or related regulations.
