APRA means the Australian Prudential Regulation Authority.

Overview

The Financial Sector (Collection of Data) Act 2001 was enacted to facilitate the collection of data from entities within the financial sector, thereby enhancing regulatory oversight and financial stability. The Act establishes the framework under which the Australian Prudential Regulation Authority (APRA) maintains a register of entities and a corresponding list of registered entities. The primary purpose of this legislation is to ensure that APRA can efficiently manage and monitor the entities it regulates, which is crucial for maintaining the integrity and robustness of the financial system. This legislation was introduced by the Commonwealth Parliament, aiming to create a comprehensive system for the collection and management of financial data, thus addressing the need for a robust regulatory framework in the financial sector. The 2013 gazette, C2013G00714, pertains to a specific variation of the list of names and categories of registered entities under the Financial Sector (Collection of Data) Act 2001. The gazette signifies that Pepper Europe Holdings Pty Ltd, a corporation with the ABN 160 125 646, has been added to APRA's register and subsequently to the list of registered entities. This variation was authorised by Barton Ashcroft, a delegate of APRA, under the authority conferred by subsection 11(2) of the Act, reflecting the ongoing process of updating the register to include new entities that meet the criteria for registration.

Scope and Application

The Financial Sector (Collection of Data) Act 2001 applies to entities within the financial sector that are required to provide data to the Australian Prudential Regulation Authority (APRA). This legislation mandates the collection of data from specific entities to ensure the stability and efficiency of the financial sector. The Act primarily applies to entities that are defined as registrable corporations under section 7 of the Act. These entities are required to be registered and their names and particulars maintained on a list by APRA under section 11 of the Act. The geographic reach of the Act is national, encompassing all entities operating within Australia’s financial sector. While the Act broadly applies to relevant entities, certain exclusions and exemptions may apply based on specific criteria or thresholds outlined in the legislation. The Act also allows for the extension or restriction of its application through subordinate instruments, which may provide additional guidance or specific requirements for data collection. The recent variation of the list of names and categories of registered entities by APRA under subsection 11(2) of the Act illustrates the dynamic nature of the regulatory framework, ensuring that the list remains current and comprehensive.

Key Provisions

The main operative sections of the Gazette, C2013G00714, focus on the variation of the list of names and categories of registered entities under the Financial Sector (Collection of Data) Act 2001 (the Act). Specifically, section 11 of the Act requires the Australian Prudential Regulation Authority (APRA) to maintain a list of registered entities, and subsection 11(2) allows for the variation of this list. In this instance, Barton Ashcroft, a delegate of APRA, has exercised the power under subsection 11(2) to add Pepper Europe Holdings Pty Ltd to this list. Section 8 of the Act mandates that APRA maintains a Register of Entities, which includes details of all registered entities, while section 7 defines the term 'registrable corporation'. Under paragraph 10(a) of the Act, APRA has added Pepper Europe Holdings Pty Ltd to the register, which consequently makes it a registered entity under subsection 5(3) of the Act. The Act imposes several obligations and requirements on APRA concerning the management of the register and the list of registered entities. APRA is required to ensure that the register is kept up to date with accurate information about all registered entities. This includes not only maintaining the list of names of registered entities but also ensuring that any changes to this list, such as the addition of a new entity, are properly recorded and communicated. The obligations extend to verifying that new entities meet the criteria for registration, as outlined in section 7 of the Act. This verification process ensures that only entities that qualify as 'registrable corporations' are included in the register and the associated list. Breaching the obligations set out in the Act can result in both civil and criminal consequences. Although the Gazette does not specify the exact nature of these penalties, the Act generally provides for fines and other sanctions for non-compliance. For instance, under section 16 of the Act, APRA may face fines for failing to maintain accurate records or for not properly updating the register. Additionally, individuals who intentionally provide false or misleading information to APRA could be subject to criminal penalties, including imprisonment. The specific maximum penalties for such offences are not detailed in the Gazette but would be outlined in the Act itself, where they are likely to be substantial, reflecting the importance of accurate data collection in the financial sector. In summary, the Gazette, C2013G00714, details the process by which Pepper Europe Holdings Pty Ltd has been added to the list of registered entities under the Financial Sector (Collection of Data) Act 2001. It outlines the legislative framework that APRA follows in maintaining the register and the list of registered entities. The obligations imposed on APRA include ensuring the accuracy and currency of the register, while breaches of these obligations can lead to significant civil and criminal penalties. This notice underscores the importance of precise and timely data collection in the financial sector.
