Interpretation

In this Notice

APRA means the Australian Prudential Regulation Authority.

Overview

The Financial Sector (Collection of Data) Act 2001 was enacted to facilitate the regulation of financial services in Australia by ensuring the Australian Prudential Regulation Authority (APRA) has access to necessary information for effective oversight. This Act was introduced to address the need for a comprehensive framework that allows APRA to collect and maintain critical data on financial entities, thus supporting the stability and integrity of Australia’s financial sector. The policy objective of the Act is to enable APRA to monitor and regulate entities within the financial sector effectively, thereby protecting consumers and maintaining financial stability. The Australian Parliament enacted this Act, and it authorises APRA to maintain a Register of Entities and a list of registered entities, ensuring that APRA has up-to-date and accurate information on all entities subject to its regulatory oversight.

Scope and Application

The Financial Sector (Collection of Data) Act 2001 applies to entities within the financial sector that are required to be registered with the Australian Prudential Regulation Authority (APRA). This Act mandates that APRA maintain a register of entities and a corresponding list of their names. The legislation serves to ensure that entities within the financial sector, including banks, insurance companies, and other financial institutions, are appropriately regulated and monitored. The Act applies on a national level across Australia, impacting all entities within its jurisdiction regardless of state or territory boundaries. The legislation does not specify any exclusions or exemptions, meaning that all entities within the financial sector that meet the criteria for registration must comply with the Act's requirements. Additionally, the Act allows for the scope and application to be extended or restricted through subordinate instruments, enabling APRA to adapt the regulations to evolving industry standards and practices. This Notice, dated 20 May 2015, specifically pertains to the addition of NCO Finance (Australia) Pty Ltd to the register and list of names, reflecting the entity's new status as a registrable corporation under the Act.

Key Provisions

The key operative sections of the legislation revolve around the registration and listing of entities within the scope of the Financial Sector (Collection of Data) Act 2001. Section 8 of the Act establishes the requirement for the Australian Prudential Regulation Authority (APRA) to maintain a Register of Entities, while section 11 mandates APRA to maintain a list of the names of registered entities. The addition of NCO Finance (Australia) Pty Ltd to this register and list, as outlined in subsection 11(2), is formalised through the gazette notice (C2015G00782) dated 20 May 2015. This legislative amendment ensures that the corporation, having met the criteria defined in section 7 of the Act, is recognised as a registrable corporation and subsequently included in the list of registered entities. The obligations imposed by the Act on the parties and entities it governs are primarily administrative in nature. APRA is required to maintain and update the Register of Entities and the list of names of registered entities under sections 8 and 11 respectively. This includes the procedural obligation to add new entities that meet the criteria for registration. Additionally, entities such as NCO Finance (Australia) Pty Ltd must ensure they meet the criteria outlined in section 7 of the Act, thereby becoming eligible for inclusion in the register and list. This formal recognition under the Act facilitates regulatory oversight and compliance requirements for these entities. Breaches of the provisions under the Financial Sector (Collection of Data) Act 2001 can result in various civil and criminal consequences. While the specific offences, penalties, and maximum penalties are not detailed within the provided text, it is understood that non-compliance with the Act's requirements could lead to enforcement actions by APRA. These may include fines, regulatory sanctions, and potential legal proceedings. The precise nature and extent of these consequences would typically be outlined in other sections of the Act or in related regulatory guidelines, but the potential for significant penalties underscores the importance of adherence to the statutory obligations and requirements set forth in the Act.
