Overview
The Financial Sector (Collection of Data) Amendment (Variation of List of Names and Categories of Registered Entities) Rules 2016 (C2016G00316) were introduced to address the issue of maintaining an accurate list of registered entities in the financial sector, ensuring that entities which are no longer required to register are appropriately removed from the register. This instrument was enacted to amend the Financial Sector (Collection of Data) Act 2001, aiming to keep the list of registered entities up-to-date and reflective of the current regulatory landscape. The Australian Prudential Regulation Authority (APRA) is responsible for maintaining the Register of Entities and the list of names of registered entities under the Act. The policy objective of this amendment is to ensure the accuracy and relevance of the information held by APRA, thereby enhancing the effectiveness of financial sector regulation.
Scope and Application
The Financial Sector (Collection of Data) Act 2001 applies to entities within the financial sector that are required to register with the Australian Prudential Regulation Authority (APRA). The Act mandates the collection of data from these registered entities to ensure the stability and integrity of the financial sector. The Act applies to a broad range of entities, including banks, credit unions, insurance companies, and other financial institutions, ensuring comprehensive oversight and regulation. The Act's jurisdiction extends nationally, applying across the Commonwealth of Australia, thereby covering all states and territories. Certain entities are exempted from registration under specific conditions, such as those outlined in paragraph 7(2)(j) of the Act. This Notice specifically addresses the variation of the list of names of registered entities by removing the names of corporations that are no longer required to register with APRA and have been deregistered with the Australian Securities and Investments Commission. The scope of the Act is further extended or restricted through subordinate instruments, which may provide additional details or clarifications on the registration requirements and exemptions.
Key Provisions
The main operative sections of the legislation in question are sections 8 and 11 of the Financial Sector (Collection of Data) Act 2001. Section 8 mandates that the Australian Prudential Regulation Authority (APRA) maintains a Register of Entities, referred to as the "register." Section 11 requires APRA to maintain a list of the names of registered entities, referred to as the "list." The list is subject to variation by a delegate of APRA under subsection 11(2) of the Act. This specific legislation pertains to the variation of the list by removing the names of certain corporations that have been exempted from registration by APRA.
The Act imposes certain obligations and requirements on APRA. Under section 8, APRA must maintain a comprehensive register of entities that are subject to data collection requirements. Section 11 further mandates that APRA keeps a list of the names of these registered entities, ensuring that the information is current and accurate. Additionally, APRA is responsible for updating this list as necessary, including the removal of entities that are no longer required to be registered, as outlined in the legislation.
There are no specific offences, penalties, or civil or criminal consequences outlined in this legislation for the failure to comply with the requirements. The primary focus of the legislation is to update the list of registered entities accurately and ensure that it reflects the current status of entities that are or are no longer subject to registration under the Act. The variation of the list by removing the names of exempted corporations is a procedural update rather than a punitive measure.
