Interpretation
In this Notice
APRA means the Australian Prudential Regulation Authority.
Overview
The Financial Sector (Collection of Data) Act 2001, enacted by the Commonwealth Parliament, was introduced to address the need for the Australian Prudential Regulation Authority (APRA) to maintain and update information about financial sector entities. This act provides APRA with the authority to collect and manage data on financial institutions, ensuring they comply with prudential standards and regulations. The policy objective of the Act is to safeguard the stability and integrity of the financial system by ensuring that APRA has the necessary information to monitor and regulate financial entities effectively. A recent legislative instrument, Gazette C2014G01530, pertains to the variation of the list of names and categories of registered entities maintained by APRA. This specific instrument, issued under the authority of the Act, reflects the addition of Bluebay Home Loans Pty Ltd to the register of entities, thereby updating the list of registered entities in accordance with the legislative framework.
Scope and Application
The Financial Sector (Collection of Data) Act 2001 applies to entities that fall within the scope of the Australian Prudential Regulation Authority's (APRA) regulatory purview, specifically those that meet the criteria for registration under section 7 of the Act. This Act mandates APRA to maintain a Register of Entities and a List of Names and Categories of Registered Entities, which is used to monitor and regulate financial institutions to ensure compliance with financial sector obligations and standards. The geographic reach of the Act is national, as it applies across Australia and is overseen by a Commonwealth authority, APRA. The Act applies to entities involved in financial services and transactions, including but not limited to banks, insurance companies, and other financial intermediaries. Any entity that is deemed a registrable corporation under section 7 of the Act must be included in APRA's register and the corresponding list, as specified under section 11. The Act does not specify exclusions or exemptions but allows for the inclusion of entities through subordinate instruments such as the one mentioned, which involves the addition of Bluebay Home Loans Pty Ltd to the list of registered entities. This demonstrates the Act's capacity to adapt to new entities entering the financial sector by updating the register and list accordingly.
Key Provisions
The primary operative sections of this legislation involve the maintenance and variation of the list of names and categories of registered entities, which are governed by sections 8, 11, 7, 10(a), and 5(3) of the Financial Sector (Collection of Data) Act 2001. Section 8 establishes that the Australian Prudential Regulation Authority (APRA) maintains a Register of Entities, while section 11 mandates that APRA also maintains a list of the names of these registered entities. Section 7 defines what constitutes a registrable corporation, section 10(a) requires APRA to add the names of such corporations to the register, and section 5(3) clarifies that these corporations, upon registration, become registered entities. The Notice, dated 7 September 2014, signed by John Hotham, a delegate of APRA, varies the list by adding the name of Bluebay Home Loans Pty Ltd, an entity now recognised as a registered corporation.
The Act imposes specific obligations and requirements on APRA and the registered entities. APRA is tasked with maintaining the Register of Entities and the list of names of these entities, ensuring that all registrable corporations are accurately recorded. Section 11(2) of the Act empowers APRA to update the list by adding the names of new entities as they become registrable. For the registered entities, the Act necessitates compliance with the data collection requirements that APRA may impose, ensuring that the entities provide the necessary information to be included in the register.
The legislation also outlines potential consequences for non-compliance. Although the specific offences, penalties, or civil/criminal consequences are not detailed in this particular Notice, breaches of the Financial Sector (Collection of Data) Act 2001 can lead to significant legal repercussions. Under the Act, entities that fail to comply with data collection requirements may face penalties, including fines or other sanctions, depending on the severity of the breach. The Act provides a framework for enforcing compliance, but the exact penalties and consequences are typically specified in other parts of the legislation or in associated regulations. The overarching goal is to ensure that the financial sector maintains transparency and accountability through comprehensive data collection and reporting.
