Overview

The Variation of List of Names and Categories of Registered Entities Financial Sector (Collection of Data) Act 2001 is a legislative instrument issued by the Australian Prudential Regulation Authority (APRA) to update the list of registered entities under the Act. Enacted by the Parliament of Australia, the Act was introduced to address the need for accurate and up-to-date information on entities subject to APRA's regulatory oversight. This particular legislative instrument, gazetted in 2012, specifically serves to incorporate the names of new entities into the register, ensuring that APRA's records reflect the current status of entities that are required to be registered. The policy objective of the Act is to maintain a reliable and comprehensive register of financial sector entities, facilitating effective regulatory supervision and enforcement. This legislative instrument underscores the ongoing commitment of APRA to adapt to changes within the financial sector, ensuring that all entities subject to regulatory oversight are appropriately identified and managed. By varying the list of registered entities, APRA ensures that its regulatory framework remains robust and relevant, supporting the stability and integrity of the financial system. The legislative process reflects a structured approach to updating regulatory records, highlighting the importance of accurate data in the effective regulation of financial entities in Australia.

Scope and Application

The Financial Sector (Collection of Data) Act 2001 applies to entities within the financial sector that are subject to the regulatory oversight of the Australian Prudential Regulation Authority (APRA). This Act mandates the collection and maintenance of data concerning entities such as banks, credit unions, authorised deposit-taking institutions, and other financial entities that meet the criteria of being registrable corporations as defined in section 7 of the Act. The Act's application extends to the Commonwealth and any other entities that APRA regulates, ensuring that the register and list of names of registered entities maintained by APRA are comprehensive and up-to-date. APRA, under its authority, adds the names of corporations to its Register of Entities and the list of registered entities, thereby ensuring that all entities subject to its regulatory purview are accurately documented. This Act does not specify any exclusions, exemptions, or thresholds but allows for further definition and elaboration through subordinate instruments.

Key Provisions

The Financial Sector (Collection of Data) Act 2001 (the Act) establishes a framework for the collection and management of data within the financial sector, with the Australian Prudential Regulation Authority (APRA) playing a central role. Under section 8 of the Act, APRA maintains a Register of Entities, which is a comprehensive record of all entities subject to regulatory oversight. Section 11 of the Act mandates that APRA also maintains a list of the names of these registered entities. This list is publicly available and serves as an official record of all entities currently registered under the Act. The key operative sections in this context are sections 8 and 11, which require APRA to maintain both the Register of Entities and the List of Names. Section 7 defines what constitutes a registrable corporation, while section 10(a) empowers APRA to add entities to the Register once they meet the criteria. The inclusion of a corporation in the Register automatically makes it a registered entity under subsection 5(3) of the Act. Consequently, the variation of the List of Names under subsection 11(2) is a formal process that updates the public record to reflect the addition of new entities. The obligations imposed by the Act on APRA and the registered entities include the accurate and timely updating of the Register and the List of Names. APRA must ensure that any new registrable corporation is added to the Register and subsequently to the List of Names, thereby making it a registered entity. Registered entities, in turn, must comply with all reporting and data collection requirements as stipulated by APRA. Failure to meet these obligations can lead to administrative penalties and may impact the entity's standing under the Act. The Act does not explicitly outline specific offences, penalties, or consequences for non-compliance with the registration and listing requirements. However, non-compliance with data collection and reporting obligations under the Act may result in civil or criminal penalties as provided for in other sections of the Act or related legislation. The maximum penalties can vary, but generally, they include fines and, in more severe cases, imprisonment. The precise nature and extent of penalties depend on the specific provisions of the Act and any relevant case law.
