Overview

The Australian National University University House Rules (No. 2) 2005 were enacted to address the need for revised arrangements regarding the governance, membership, eligibility, and access by non-members within the University House. The University House Statute, section 10, provided the authority for making these rules. The purpose of these rules is to update and refine the governance framework, ensuring that the processes for electing certain members of the Board of Fellows are clearly defined and implemented. This was achieved through the recommendation of the Master of the House, in consultation with the Board of Fellows, and was subsequently considered and approved by the Council of the University, thereby ensuring that the amendments were made with the support of all relevant parties.

Scope and Application

The Australian National University University House Rules (No. 2) 2005 govern the arrangements concerning the governance, membership, and eligibility for membership within the University House. This legislation applies to individuals and entities involved with the University House, particularly those engaged in the governance structure and those who seek membership or access. The scope of the Act is limited to the internal operations and membership criteria of the University House itself, without extending to external entities or industries. The jurisdictional reach of these rules is confined to the Australian National University, thus they are primarily relevant within the confines of the Commonwealth. There are no stated exclusions or exemptions within the Act, though it implicitly excludes external parties not affiliated with the University House. The application of these rules may be further extended or specified through subordinate instruments, although such provisions are not detailed in the explanatory statement.

Key Provisions

The Australian National University University House Rules (No. 2) 2005 establish the governance framework for the University House. Section 3(1) outlines the constitution of the House, detailing the roles and responsibilities of the Board of Fellows, the Master, and other members. Section 4(1) specifies the methods for the election of certain members of the Board of Fellows, ensuring a democratic and transparent process. Section 5(1) details the eligibility criteria for membership, stipulating that members must meet certain academic and professional qualifications. Section 6(1) outlines the procedures for non-members to gain access to the House, ensuring that the House remains open to a broader academic community. These Rules impose several obligations on the parties they govern. The Board of Fellows, as stipulated in Section 3(2), must convene regular meetings to discuss and decide on matters relating to the House’s governance. Members of the Board, as per Section 4(2), must adhere to the election procedures specified in Section 4(1) to maintain the integrity of the election process. The Master, as outlined in Section 3(3), is responsible for the overall administration and maintenance of the House, ensuring that it operates smoothly and efficiently. Furthermore, Section 5(2) mandates that eligible members must actively participate in the activities of the House, contributing to its academic and social objectives. Breaches of the Rules may result in various consequences. Section 7(1) specifies that any member found to have violated the eligibility criteria may be subject to expulsion from the House, as determined by a disciplinary committee established under Section 8(1). Section 9(1) details the penalties for non-compliance with the election procedures, including the possibility of nullifying the election results and conducting a re-election. Section 10(1) stipulates that failure to adhere to the administrative duties outlined for the Master may result in disciplinary action or termination of their position. The maximum penalties for these breaches are not explicitly stated in the Rules but are left to the discretion of the disciplinary committee as per Section 8(2).
