Overview

The Australian National University University House Rules 2012 were enacted to provide a framework for the governance, membership, fee setting, and access arrangements of University House, a residential college of the Australian National University. This legislation was introduced to address the need for a comprehensive set of rules governing the operations of University House. The enacting body for these rules was the Council of the Australian National University, which approved the rules on 25 May 2012. The policy objective behind these rules is to ensure that University House is managed in a manner that aligns with the broader governance structures and objectives of the Australian National University, while also providing a supportive and inclusive environment for its residents.

Scope and Application

The Australian National University University House Rules 2012, as outlined in the explanatory statement, are designed to provide a comprehensive framework for the governance and membership of University House, along with the establishment of fees and charges and the conditions for access to the House by non-members. The instrument is made under the authority of the University House Statute, specifically section 10, which empowers the creation of these rules to ensure the effective administration of the House. The rules are intended to operate by setting out clear procedures and criteria for the membership and governance of University House, establishing a transparent fee structure, and defining the terms under which non-members may access the facilities provided by University House. Importantly, these rules do not incorporate any external documents by reference and were subject to internal review and approval by the Council of the Australian National University before their implementation on 25 May 2012, as documented by the Governance Office on 28 May 2012. The application of these rules is limited to the governance, membership, fees, and access conditions within the specific context of University House at the Australian National University, and there are no stated exclusions, exemptions, or jurisdictional thresholds that extend beyond this scope.

Key Provisions

The Australian National University University House Rules 2012 (the "Rules") outline the governance structure and membership arrangements of University House, as well as the setting of fees and access by non-members. Section 10 of the University House Statute provides the authority for making these Rules, which were approved by the University Council on 25 May 2012 and implemented on 28 May 2012. The Rules are comprehensive and provide a clear framework for the management and operation of University House. Under the Rules, the governance of University House is overseen by a Board, which is responsible for making decisions on behalf of the House (Section 4). The Board consists of a number of members, including representatives of the University, the House's tenants, and other stakeholders. The Rules also establish a number of committees to assist the Board in carrying out its functions, including a Finance Committee and a Membership Committee (Section 5). These committees are responsible for making recommendations to the Board on key issues, such as the setting of fees and charges and the admission of new members. The Rules impose a number of obligations on the Board and its members, including a duty of care and diligence, a requirement to act in the best interests of the House, and a duty of confidentiality (Section 6). The Rules also establish a number of procedures for the operation of the Board, including the requirement for regular meetings and the keeping of minutes (Section 7). These obligations and requirements are designed to ensure that the Board is able to effectively carry out its functions and to protect the interests of the House and its members. Failure to comply with the Rules may result in a number of consequences, including disciplinary action against Board members, the imposition of fines, and legal action (Section 10). The maximum penalties for breaches of the Rules are not specified in the Explanatory Statement, but may be found in the Rules themselves. Overall, the Rules provide a comprehensive framework for the governance and operation of University House, and are designed to ensure that the House is able to effectively carry out its functions while protecting the interests of its members and stakeholders.
