Overview

The Statutory Rules of 1947, made under the Education Act 1945, were enacted to amend financial assistance regulations for universities, ensuring that the provisions remain current and relevant. The Education Act 1945, enacted by the Commonwealth Parliament, aimed to provide a framework for educational standards and financial aid to support higher education institutions. These regulations specifically address amendments to the Universities Commission (Financial Assistance) Regulations to adjust the financial support amounts for students in the year 1947, ensuring that the aid provided aligns with the economic conditions of the time. The policy objective behind these amendments is to provide adequate financial assistance to students, facilitating access to higher education while maintaining the integrity of the funding structure as stipulated by the Act.

Scope and Application

The Regulations under the Education Act 1945, enacted by the Governor-General with the advice of the Federal Executive Council, modify the Universities Commission (Financial Assistance) Regulations, specifically addressing financial assistance to students in 1947. The Regulations apply to students receiving financial assistance from the Universities Commission, thereby affecting the educational sector directly. The amendments adjust the amounts of financial assistance, with specific figures updated to reflect changes in economic conditions for that year. The geographic scope of these regulations is nationwide, applying to all universities in Australia that are recipients of Commonwealth funding for student financial assistance. Notably, the regulations do not specify exclusions or exemptions, implying that all eligible students under the Universities Commission's purview are subject to these changes. Furthermore, the Regulations extend their application through subordinate instruments, allowing for further detailed specifications and adjustments as necessary within the framework of the Education Act 1945.

Key Provisions

The statutory regulations under the Education Act 1945, specifically outlined in Statutory Rules 1947, No. 89, primarily serve to amend the financial assistance provisions for students attending universities. The key operative sections of these regulations (sections 1 and 2) involve changes to the amounts of financial assistance that can be granted to students in the year 1947. In section 1, the amounts specified in the Universities Commission (Financial Assistance) Regulations are adjusted from "One hundred and four pounds" to "One hundred and seventeen pounds" and from "One hundred and forty-three pounds" to "One hundred and fifty-six pounds." However, section 2 provides specific amounts for determining maximum financial assistance for students in 1947, setting these amounts at "One hundred and ten pounds and ten shillings" and "One hundred and forty-nine pounds and ten shillings" respectively. These regulations impose obligations on the Universities Commission to ensure that the financial assistance provided to students aligns with the specified amounts. The amendments necessitate that the Commission review and possibly adjust its financial assistance programs to comply with the new figures. Additionally, educational institutions and students must be informed of these changes to ensure transparency and compliance with the updated financial support structures. Failure to adhere to the financial assistance amounts specified in these regulations may result in legal consequences. Although the regulations do not explicitly detail offences, penalties, or civil/criminal consequences for non-compliance, breaches could potentially lead to legal action under the overarching Education Act 1945. The Education Act itself may outline various penalties for non-compliance with its provisions, which could include fines or other sanctions. Given the context and the nature of the amendments, any significant deviation from the specified financial assistance amounts could be scrutinized and may result in corrective measures being enforced by the relevant authorities.
