An Act to deal with consequential matters arising from the enactment of the Universities Accord (National Higher Education Code to Prevent and Respond to Gender‑based Violence) Act 2025, and for related purposes

The Parliament of Australia enacts:
1 Short title
This Act is the Universities Accord (National Higher Education Code to Prevent and Respond to Gender‑based Violence) (Consequential Amendments) Act 2025.
2 Commencement
(1) Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

The whole of this Act | The later of: (a) the start of the day after this Act receives the Royal Assent; and (b) the commencement of the Universities Accord (National Higher Education Code to Prevent and Respond to Gender‑based Violence) Act 2025. However, the provisions do not commence at all if the event mentioned in paragraph (b) does not occur. | 29 August 2025 |
Note: This table relates only to the provisions of this Act as originally enacted. It will not be amended to deal with any later amendments of this Act.

3 Schedules
Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.
Schedule 1—Amendments
Higher Education Support Act 2003
1 At the end of Subdivision 19‑C
Add:
19‑20 Certain providers must comply with the National Higher Education Code to Prevent and Respond to Gender‑based Violence
(1) A higher education provider that is a higher education provider within the meaning of the Universities Accord (National Higher Education Code to Prevent and Respond to Gender‑based Violence) Act 2025 must comply with the National Higher Education Code to Prevent and Respond to Gender‑based Violence made under that Act.
(2) This section begins to apply to a higher education provider:
(a) if the provider is a Table A provider or a Table B provider—on 1 January 2026; or
(b) otherwise—on 1 January 2027.
