Overview

The Provisional Regulations under the Defence Act 1903-1912, specifically concerning Universal Training Regulations for Senior Cadets, were enacted in 1914 to address urgent needs related to the training and commission of officers within the Citizen Forces. This legislative instrument was certified by Sir Arthur Stanley, acting as the Deputy of the Governor-General, following advice from the Federal Executive Council. The primary purpose of these regulations was to modify the conditions under which substantive commissions were granted to Senior Cadet officers, ensuring that such commissions aligned with the qualifications and conditions applicable to Citizen Forces officers. By amending the previous regulation, the intent was to streamline the process of appointing and promoting officers within the Cadet system while maintaining the integrity of the commissions based on the established syllabus and conditions.

Scope and Application

The Provisional Regulations under the Defence Act 1903-1912, specifically targeting Universal Training Regulations, Part III, Senior Cadets, apply to officers within the Senior Cadets who were appointed prior to 1st July 1914. These officers must qualify for their rank according to the syllabus and conditions applicable to officers of the Citizen Forces. Upon meeting these criteria, they are granted a substantive commission and listed on the Unattached List of the Citizen Forces. However, this commission is not retained upon promotion to a higher rank within the Senior Cadets unless the officer also meets the requisite syllabus and conditions for the Citizen Forces. The commission is withdrawn when the officer ceases to serve with the Senior Cadets. These regulations are set to come into immediate operation as certified by the Governor of the State of Victoria, acting as the Deputy of the Governor-General, and are applicable on a Commonwealth level, as evidenced by their publication by the Government Printer for the State of Victoria.

Key Provisions

The Provisional Regulations under the Defence Act 1903-1912, specifically amending Universal Training Regulation 42, pertain to the qualifications and commissions of officers in the Senior Cadets. According to the amended Regulation 42(1), an officer of the Senior Cadets appointed before 1 July 1914 who meets the syllabus and conditions applicable to officers of the Citizen Forces shall be granted a substantive commission and listed on the Unattached List of the Citizen Forces. This change focuses on officers appointed prior to a specific date, differentiating them from those appointed after. Regulation 42(2) states that an officer granted a substantive commission will not retain it if promoted to a higher rank within the Senior Cadets unless they qualify for the higher rank under the same syllabus and conditions as Citizen Forces officers. This ensures that promotion within the Senior Cadets does not automatically confer a substantive commission without meeting the requisite qualifications. Regulation 42(3) stipulates that the substantive commission will be withdrawn when the officer ceases to serve with the Senior Cadets, thereby maintaining the link between service and commission. These regulations impose specific obligations on Senior Cadet officers. Firstly, they must qualify under the syllabus and conditions applicable to Citizen Forces officers to be granted a substantive commission. This requirement ensures that only qualified officers are recognised with a substantive commission. Secondly, officers granted a substantive commission must meet the same qualifications for any higher rank within the Senior Cadets to retain their commission. This stipulation maintains a standard of competence and qualification throughout the ranks of the Senior Cadets. Finally, officers must understand that their substantive commission will be withdrawn upon cessation of service with the Senior Cadets, emphasising the conditional nature of their commission based on active service. Failure to comply with these regulations could result in significant consequences. While the specific offences and penalties are not detailed within the provided text, it is reasonable to infer that breaches of the commission and qualification requirements could lead to disciplinary actions, including the revocation of commissions or other penalties as prescribed by the Defence Act 1903-1912 or subsequent regulations. The text does not specify maximum penalties, but given the context of military regulations, breaches could potentially result in both civil and criminal consequences, depending on the severity and nature of the infraction.
