Overview
The United States Naval Communication Station (Civilian Employees) Act 1972 was enacted to amend the United States Naval Communication Station (Civilian Employees) Act 1971, reflecting the changes brought about by the Compensation (Commonwealth Employees) Act 1972. This Act was assented to on 2 November 1972 by the Queen, the Senate, and the House of Representatives of the Commonwealth of Australia. It aims to incorporate modifications to the Compensation (Commonwealth Employees) Act 1971–1972, specifically addressing the civilian employees of the United States Naval Communication Station. The legislative intent is to ensure that the amended provisions of the original Act align with the new compensation framework for Commonwealth employees, thereby maintaining consistency and fairness in the treatment of civilian employees under the United States' jurisdiction within Australia.
Scope and Application
The United States Naval Communication Station (Civilian Employees) Act 1972 pertains specifically to civilian employees of the United States Naval Communication Station in Australia. This Act is a modification of the Compensation (Commonwealth Employees) Act 1971–1972, which was enacted to adjust the compensation provisions for civilian employees working at the United States Naval Communication Station, following the enactment of the Compensation (Commonwealth Employees) Act 1972. This legislation applies across the Commonwealth of Australia, and its amendments reflect adjustments necessary due to the involvement of the United States Government in the employment of these civilian workers. The Act integrates the compensation and employment terms of civilian employees at the station with those applicable to Commonwealth employees, ensuring that these workers are treated similarly in terms of compensation and benefits. The Act's amendments extend its provisions to include the Government of the United States of America, thereby encompassing civilian employees of this entity under the same legislative framework as Commonwealth employees.
Key Provisions
The United States Naval Communication Station (Civilian Employees) Act 1972 primarily serves to amend the United States Naval Communication Station (Civilian Employees) Act 1971, making modifications in light of the enactment of the Compensation (Commonwealth Employees) Act 1972. The main operative sections of this Act, detailed in the Schedule, involve the insertion of specific phrases into various sections of the 1971 Act. For example, section 5(1) and section 5(7) now include the phrase "or of the Government of the United States of America" within their definitions, and section 36(2), section 36(3), and section 45(2b) have similar insertions after references to "the Commonwealth."
The obligations imposed by the Act are essentially modifications to the existing framework governing civilian employees at the United States Naval Communication Station. These amendments ensure that certain provisions that previously only applied to the Commonwealth now also apply to the Government of the United States of America. This means that any policies, benefits, or regulatory requirements that the Commonwealth is subject to under the Compensation (Commonwealth Employees) Act 1972 will now also apply to employees of the United States Government stationed in Australia under the terms of the 1971 Act.
Failure to comply with the provisions of this Act could potentially lead to legal consequences, though specific offences and penalties are not detailed in the text provided. The penalties for non-compliance would likely depend on the particular breach and the context of the relevant sections in the Compensation (Commonwealth Employees) Act 1972, to which this Act is making amendments. In general, breaches of employment or compensation laws in Australia can lead to both civil and criminal consequences, including fines and imprisonment for more serious offences. The exact penalties would be determined by the specific nature of the breach and the applicable laws governing employment and compensation at the time.
