Overview

The Unit Citations Regulations were enacted in 1991 under the authority of the Queen, represented by the Governor-General, and signed by the Prime Minister of the time, Bob Hawke. This legislation was introduced to address the need for a formal recognition system for units within the Defence Force and allied forces that had displayed exceptional bravery and service in warlike operations. The objective of these regulations is to provide a means to honour and commemorate such units through the establishment of two distinct decorations: the Unit Citation for Gallantry and the Meritorious Unit Citation. The former is awarded for acts of extraordinary gallantry in action, while the latter recognises sustained outstanding service in warlike operations. These awards are designed to be a mark of honour for the units and their members, reinforcing the values of courage and dedication in military service.

Scope and Application

The Unit Citations Regulations establish the framework for the awarding of the Unit Citation for Gallantry and the Meritorious Unit Citation to units of the Defence Force and allied forces. These citations are intended to recognise extraordinary gallantry in action or sustained outstanding service in warlike operations. The Regulations apply to the units of the Defence Force and other defence forces, as well as to any individuals who were members of a unit at the time of an action or during the period to which a citation relates, or who were engaged in the performance of services with that unit. The application of these Regulations can be extended to non-members of the Defence Force by the Minister's determination. The issuance of these citations and the wearing of their insignia are governed by the provisions outlined in the Regulations, which also allow for the posthumous awarding of insignia and the cancellation or reinstatement of the right to wear the insignia. The awards are made by the Governor-General on the recommendation of the Minister, and a Registrar of Awards is appointed to maintain records of the awards and issuance of insignia.

Key Provisions

The primary sections of the Unit Citations Regulations (C2010Q00010) set out the framework for awarding two Australian military decorations: the Unit Citation for Gallantry and the Meritorious Unit Citation. The Unit Citation for Gallantry (section 3(1)) is awarded for acts of extraordinary gallantry in action, while the Meritorious Unit Citation (section 3(2)) recognises sustained outstanding service in warlike operations. Each citation comprises a certificate signed by the Governor-General and insignia designed according to prescribed standards (section 4). The Regulations also detail the conditions under which these insignia may be worn by members of the Defence Force and others (section 5). Under the Unit Citations Regulations, the Minister for Defence has the responsibility to recommend the award of these citations to the Governor-General (section 9). The Governor-General, acting on the Minister’s advice, makes the final decision on the award. The Regulations also establish the role of the Registrar of Awards, who is responsible for maintaining a Register of the units awarded citations and the individuals issued with the insignia (section 10). The Registrar's duties include managing the Register and any other records related to the awards as directed by the Governor-General. The Unit Citations Regulations outline specific consequences for breaches of the rules governing the awards. The Governor-General has the authority to cancel the right of a person to wear the insignia of a citation if certain conditions are not met (section 11(1)). When such a cancellation occurs, the person must return the insignia to the Registrar, and their name will be removed from the Register (section 11(2)). The Regulations also provide for the reinstatement of these rights if the Governor-General deems it appropriate (section 11(3)). While the Regulations do not specify financial penalties, the cancellation of the right to wear the insignia and the requirement to return the insignia are significant disciplinary measures. Additionally, the Regulations make it clear that the award of a citation to a unit does not preclude individual members of the unit from receiving separate recognition for their gallantry or service (section 8). This ensures that the collective recognition provided by the unit citations does not overshadow individual achievements. The application of the Regulations extends to non-members of the Defence Force who were engaged with the unit during the relevant period, provided the Minister determines that they should be subject to the same rules (section 7). This inclusivity ensures that all who contribute to the unit's success are appropriately recognised.
