Overview

The Tradesmen’s Rights Regulation Act 1958 was enacted to amend the Tradesmen’s Rights Regulation Act 1946–1955, addressing gaps in the existing legislation concerning tradesmen’s rights and certifications. This Act was passed by the Queen’s Most Excellent Majesty, the Senate, and the House of Representatives of the Commonwealth of Australia, with the primary policy objective of updating the qualifications and recognition processes for tradesmen. It introduced new provisions for the granting of tradesman’s certificates, replacing the previous certificate of recognition for recognized tradesmen. This Act aimed to streamline and modernise the regulatory framework governing the employment and recognition of tradesmen, ensuring that the legislation remains relevant and effective in protecting the rights and interests of tradesmen in Australia.

Scope and Application

The Tradesmen’s Rights Regulation Act 1958 applies to individuals and entities involved in trades and crafts within the Commonwealth of Australia. The Act primarily focuses on the regulation of tradesmen and their employment, particularly concerning the recognition, certification, and rights of tradesmen. It applies to individuals who have been employed for at least seven years in work ordinarily performed by a tradesman, who may be granted a tradesman’s certificate. The Act allows Local Committees to grant such certificates subject to the individual passing a test of competence approved by the Central Committee. Additionally, the Act details the roles and powers of both Local and Central Committees, including the ability of the Central Committee to determine classes of persons eligible for tradesman’s certificates and to set conditions for their grant. The Act’s provisions extend to the regulation of the employment of tradesmen, including specific provisions for those who became recognized tradesmen before a certain date. The geographic and jurisdictional reach of the Act is national, applying across all states and territories of Australia. The Act also includes provisions for the amendment of existing regulations and the making of new regulations to specify which trades the Act applies to. The Act includes certain exclusions and thresholds, such as the requirement for a minimum of seven years of employment in a trade to be eligible for a tradesman’s certificate. Subordinate instruments may extend or restrict the application of the Act as determined by the Governor-General.

Key Provisions

The Tradesmen’s Rights Regulation Act 1958 (the "Act") introduces several key amendments to the Tradesmen’s Rights Regulation Act 1946–1955 (the "Principal Act"). Section 1 establishes the Act’s citation and references to the Principal Act. Section 2 sets the commencement date for the Act, which is deemed to have come into operation on 2 September 1958, with provisions of the Principal Act remaining in effect until the Act receives Royal Assent. The Act introduces the concept of "tradesman's certificate" in place of the "certificate of recognition as a recognized tradesman" (sections 3, 4, 7, 8, 10, and 11). A Local Committee may grant a tradesman's certificate to an applicant who has been employed for at least seven years on work ordinarily performed by a tradesman, provided the applicant passes a competence test (section 5). Certain provisions in the Principal Act now specify that they apply to tradesmen who became recognized tradesmen before 2 September 1958 (sections 6 and 17). The obligations imposed by the Act require Local Committees to adhere to any directions from the Central Committee when exercising their powers (section 14). The Central Committee must be supported by a majority vote of its members, excluding the Chairman, when making determinations (section 15). Additionally, Local Committees must maintain a register of tradesmen's certificates and notify changes of address or employment (sections 18 and 19). The Act also modifies the powers and functions of the Central Committee, including determining classes of persons eligible for tradesman’s certificates and supervising Local Committees (section 13). The Act includes specific offences and penalties for breaches. However, the text does not provide explicit details about maximum penalties or specific civil or criminal consequences. Given the historical context, it is likely that penalties would have been outlined in regulations or other statutes, which are not detailed in the provided excerpt. Legal practitioners should refer to the full text or relevant regulations to understand the full scope of penalties associated with breaches of this Act.
