Overview
Statutory Rules 1977 No. 199, made under the Trade Commissioners Act 1933, was enacted to provide for the payment of outlay allowances to Trade Commissioners. The Trade Commissioners Act 1933 was established to facilitate the appointment and management of Trade Commissioners who represent Australian interests in overseas markets, and these regulations were introduced to address the need for standardised financial entitlements for these officials. The regulations were made by the Governor-General of the Commonwealth of Australia, acting on the advice of the Federal Executive Council. The policy objective of these amendments is to align the financial entitlements of Trade Commissioners with those of officers of the Australian Public Service, ensuring consistency and fairness in allowances.
Scope and Application
The Trade Commissioners Regulations, as amended, provide the legal framework governing the remuneration and entitlements of Trade Commissioners, who are officers appointed under the Trade Commissioners Act 1933. These Regulations apply to Trade Commissioners as individuals, detailing their entitlements, including the outlay allowance, which mirrors the entitlements of officers in the Australian Public Service. The scope of these Regulations extends nationally, impacting Trade Commissioners wherever they are deployed, whether domestically or internationally. While the primary focus is on financial entitlements, the Regulations also reference the Public Service Board and the Minister's role in administering these allowances, thereby ensuring a consistent approach to compensation and conditions across the federal government. These Regulations do not explicitly state exclusions or thresholds but are subject to amendment and further clarification through subordinate instruments, ensuring they remain aligned with broader public service policies.
Key Provisions
The Trade Commissioners Regulations 1977, under the Trade Commissioners Act 1933, introduce an additional regulation, numbered 30, regarding outlay allowances for Trade Commissioners. Regulation 30(1) stipulates that a Commissioner is entitled to an outlay allowance equivalent to what an officer of the Australian Public Service would receive. Regulation 30(2) mandates that the entitlement of a Commissioner is subject to the same conditions that apply to the corresponding entitlement of an officer of the Australian Public Service. Regulation 30(3) allows for functions related to the entitlement or conditions of entitlement of an officer of the Australian Public Service, as outlined in sub-regulation (1), to be performed by the Minister in relation to the entitlement given by this sub-regulation.
The Regulations impose specific obligations on Trade Commissioners, including the entitlement to an outlay allowance under the same conditions as Australian Public Service officers. The Minister is responsible for performing functions related to these entitlements. The conditions and entitlements are directly aligned with those of the Australian Public Service officers, ensuring consistency and fairness in allowances and related conditions.
There are no explicit offences, penalties, or civil/criminal consequences detailed within the Regulation for breach of its provisions. However, any failure to adhere to the stipulated conditions of entitlement or any misconduct in the disbursement or management of these allowances may still be subject to broader employment and administrative laws applicable to the Australian Public Service and the Trade Commissioners Act 1933. The Regulations ensure that the allowances are managed under the same regulatory framework as the Australian Public Service, thereby aligning the accountability and procedural requirements.
