Overview
The Statutory Rules 1980 No. 22, made under the Trade Commissioners Act 1933, were introduced to address administrative and operational requirements within the framework of the Trade Commissioners service. Enacted by the Governor-General of the Commonwealth of Australia, acting on the advice of the Federal Executive Council, these regulations amend the existing Trade Commissioners Regulations, particularly in relation to the salaries of various Trade Commissioner positions. This legislative instrument aims to ensure the Trade Commissioners service can effectively support Australia's trade interests by providing clear and updated salary structures for its personnel. The amendments provide a more precise and detailed breakdown of salaries across different grades, facilitating better management and alignment with current market conditions.
Scope and Application
The Trade Commissioners Regulations, established under the Trade Commissioners Act 1933, apply to Trade Commissioners and Assistant Trade Commissioners employed by the Australian Government to promote Australian exports, investments, and trade services in various overseas markets. These Regulations specifically govern the remuneration of these officials, setting out their annual salaries and salary ranges based on their respective grades and special designations. Geographically, the scope of these Regulations extends to all Trade Commissioners and Assistant Trade Commissioners operating within Australia and abroad, as the Act and Regulations are designed to facilitate and enhance Australia’s international trade relations. There are no explicit exclusions or exemptions detailed in these Regulations, which means they apply uniformly across the designated roles unless otherwise specified by subordinate instruments. The Regulations also provide for amendments to salary structures through the substitution of the salary table, thereby ensuring that remuneration remains aligned with the responsibilities and market conditions.
Key Provisions
These Regulations, coming into effect on 17 January 1980, amend the Trade Commissioners Regulations by revising the salary structure for various positions within the Trade Commissioner service (reg 2). The specific amendment is detailed in Regulation 5A, where the table listing annual salaries or salary ranges for different grades and positions is replaced with a new table (reg 2). The new table provides updated figures for positions such as Trade Commissioner (Special Grade 1), Trade Commissioner, Grade A, Trade Commissioner, Grade B, Trade Commissioner, Grade C, Assistant Trade Commissioner, Grade 1, Assistant Trade Commissioner, Grade 2, and Assistant Trade Commissioner, Grade 3. Each position now has a specified annual salary or a range of salaries reflecting the changes.
The Regulations impose several obligations on the entities they govern. Firstly, they mandate that the Trade Commissioner service adhere to the updated salary structure outlined in Regulation 5A (reg 2). This means that the salaries for the listed positions must be adjusted to reflect the figures provided in the new table. Secondly, the Regulations require that any changes to the salary structure must be formally documented and communicated to relevant parties within the service to ensure compliance. Additionally, these Regulations require that all salary adjustments be implemented promptly upon the Regulations' effective date, 17 January 1980.
Breach of these Regulations may result in various consequences, although specific offences and penalties are not detailed within the text. Generally, failure to comply with legislative instruments such as these Regulations could lead to administrative actions, including fines or other civil penalties. In severe cases of non-compliance, it might also result in criminal charges, depending on the nature and extent of the breach. However, the exact penalties for non-compliance are not specified in this particular legislative instrument and would typically be addressed in related legislation or administrative guidelines.
