DETERMINATION OF TERMS AND CONDITIONS, INCLUDING REMUNERATION AND ALLOWANCES

 

 

 

 

I, NIGEL SCULLION, Minister for Indigenous Affairs, acting as the employing body for the public office of the Torres Strait Regional Authority Chief Executive Officer, determine under subsection 12C(1) of the Remuneration Tribunal Act 1973 that the terms and conditions (including remuneration and allowances) for the Torres Strait Regional Authority Chief Executive Officer shall be those in the Schedule to this Determination. This Determination commences on the day after the date of this Determination.

Schedule – TORRES STRAIT REGIONAL AUTHORITY CHIEF EXECUTIVE OFFICER

 

The following terms and conditions will apply to a person appointed as the Torres Strait Regional Authority (TSRA) Chief Executive Officer.

 

General Terms and Conditions

 

The general terms and conditions applying to the TSRA Chief Executive Officer will be those contained in the Remuneration Tribunal Determination 2015/19.

 

Total Remuneration

 

The total remuneration reference rate for the TSRA Chief Executive Officer is $243,490 per annum.

 

Remuneration is to be calculated and administered in accordance with the provisions of Remuneration Tribunal Determination 2015/19.

 

Superannuation

 

Superannuation salary shall be no more than 73% of total remuneration; that is $177,748 per annum.

 

Salary

 

The salary payable to the TSRA Chief Executive Officer shall be total remuneration less employer superannuation assistance and any other non-cash benefits received by the TSRA Chief Executive Officer.

 

Performance Pay

 

The TSRA Chief Executive Officer is not entitled to performance pay.

 

Executive Vehicle Component of Total Remuneration

 

Where the TSRA Chief Executive Officer elects to take an executive vehicle as part of the remuneration package the salary payable will be reduced by the total value including any fringe benefits tax component and the value of any parking space provided to the TSRA Chief Executive Officer.

 


Leave

 

The TSRA Chief Executive Officer is entitled to the types of leave under Part 5 of the Remuneration Tribunal Determination 2015/19.

 

The TSRA Chief Executive Officer is entitled to leave available to TSRA employees under the TSRA Enterprise Agreement.

 

Leave is to be approved by the Minister for Indigenous Affairs or his delegate in accordance with the Instrument of Delegation.

 

Remuneration Packaging

 

The TSRA Chief Executive Officer will have access to salary packaging arrangements. These arrangements will be provided through the administrative service provider contracted to the TSRA and in accordance with any Government directive, taxation legislation and Commonwealth guidelines which apply to the TSRA and the officeholder.

 

The salary sacrifice arrangements will apply to the TSRA Chief Executive Officer in accordance with the following principles:

 

  • the TSRA Chief Executive Officer may take goods and services in lieu of salary, but must take at least 50% of total remuneration as salary, except where TSRA policies and procedures on salary packaging allow otherwise; and

 

  • there is no additional cost to the TSRA or the Commonwealth.

 

Staff Housing and Rental Deductions

 

The TSRA Chief Executive Officer is eligible for TSRA provided housing. The TSRA Chief Executive Officer is responsible for the payment of deductions from salary including rent for staff housing.

 

Personal Telephone/Telecommunications Expenses

 

The TSRA may provide the TSRA Chief Executive Officer with telephones (including a mobile phone), telecommunications and information technology equipment for business purposes.

 

The TSRA Chief Executive Officer will meet the costs of any personal phone calls and personal telecommunications services provided on telephone, telecommunications or information technology equipment provided by the TSRA.


Access to official vehicles and payment of taxi fares

 

To the extent that it is relevant and necessary on Waiben (Thursday) Island and Narupal (Horn) Island, the TSRA Chief Executive Officer may use official vehicles and have taxi fares paid for transport associated with TSRA business only.

 

The TSRA Chief Executive Officer may not access official vehicles or have taxi fares paid in respect of travel for private purposes.
