Overview

The Therapeutic Substances Act 1953-1959, as amended by Statutory Rules 1966 No. 98, was introduced to address the need for regulating the use and distribution of therapeutic substances in Australia. This legislative instrument was enacted by the Governor-General in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council. The primary objective of these regulations was to ensure that therapeutic substances are safe, effective, and of high quality, thereby protecting public health. The regulations included amendments to the remuneration for members of committees, addressing the need for updated financial compensation reflective of the time and effort required for their roles. This legislative action underscores the commitment to maintaining stringent controls over therapeutic substances and the ongoing efforts to adapt regulatory practices to meet contemporary standards and requirements.

Scope and Application

The Therapeutic Substances Regulations 1966, enacted under the Therapeutic Substances Act 1953-1959, apply to entities and individuals involved in the regulation and administration of therapeutic substances within the Commonwealth of Australia. These regulations primarily target members of committees established under the Act, including the Chairman and other members, by specifying remuneration and allowances for their attendance at committee meetings. The regulations were amended to adjust fines and allowances in response to evolving economic conditions, ensuring that the monetary penalties and allowances reflect current values. The amendments also clarify the remuneration rates for committee members, distinguishing between the Chairman and other members, and apply retroactively to meetings held from the third day of September 1965 onwards. These provisions are applicable nationally, ensuring a uniform approach across the Commonwealth in the oversight and regulation of therapeutic substances. The regulations do not specify any exclusions or exemptions, and their application is comprehensive as they are subordinate instruments of the primary Act.

Key Provisions

The main operative sections of the Therapeutic Substances Regulations 1966 include amendments to Regulation 17, which pertains to the penalty for certain offences, and Regulation 26, which governs the remuneration and allowances for members of Committees established under the Therapeutic Substances Act 1953-1959. Regulation 17 increases the penalty from one hundred pounds to two hundred dollars for specified offences. Meanwhile, Regulation 26 modifies the remuneration for committee members, setting the daily rate at thirty dollars for the Chairman and twenty-five dollars for other members attending committee meetings. These regulations impose specific obligations on the parties they govern. For example, Regulation 17 requires compliance with the updated penalty structure for certain offences, ensuring that any breach of the Therapeutic Substances Act is met with the appropriate financial sanction. Regulation 26, on the other hand, outlines the financial compensation for committee members' attendance at meetings, which is essential for ensuring the proper functioning and participation of these committees in overseeing the implementation and enforcement of the Therapeutic Substances Act. In terms of consequences for non-compliance, while the regulations themselves do not explicitly detail criminal or civil penalties for breaches, the Therapeutic Substances Act 1953-1959 provides the legal framework under which such penalties could be applied. Specifically, the Act may impose fines and other penalties for breaches of its provisions, although the exact penalties are not specified within the statutory rules but would be determined under the broader legislative framework of the Act. It is also important to note that the amendments made by these regulations apply to meetings held on or after the third day of September, 1965. This temporal application ensures that the changes are effectively integrated into the ongoing governance and oversight processes established under the Act.
