Overview

The Therapeutic Substances Act 1953-1959 was enacted to regulate the use of therapeutic substances in Australia, addressing gaps in the oversight and control of substances used for therapeutic purposes. The Act was introduced to ensure that these substances were safe and effective for public consumption. The Therapeutic Substances Regulations 1965 were subsequently made under this Act, as evidenced by Statutory Rules 1965, No. 18, issued by the Governor-General in accordance with the Federal Executive Council’s advice. The Regulations aim to update the remuneration and allowances for members of committees involved in the regulation of therapeutic substances, reflecting the need to fairly compensate committee members for their time and expertise. This legislative framework was developed to uphold the policy objective of safeguarding public health by ensuring that therapeutic substances are properly regulated and monitored.

Scope and Application

The Therapeutic Substances Act 1953-1959 applies to the regulation and control of therapeutic substances in Australia, encompassing the manufacture, importation, exportation, and distribution of these substances. These regulations govern various entities such as pharmaceutical companies, medical practitioners, and suppliers, ensuring that therapeutic substances meet safety, quality, and efficacy standards. The scope of the Act extends across the Commonwealth, thereby affecting all states and territories in Australia. Notably, the Therapeutic Substances Regulations, including amendments such as those set forth in Statutory Rules 1965 No. 18, govern specific aspects of the Act, such as the remuneration and allowances of committee members involved in the oversight of therapeutic substances. This particular regulation alters the allowance for travel expenses, impacting those who are entitled to such reimbursements for their duties related to the Act. The regulations are designed to be applied nationally, with specific amendments impacting all relevant entities within the therapeutic substances industry from the effective date specified in the regulations.

Key Provisions

The primary operative sections of the Therapeutic Substances Regulations, as amended, include the alteration of remuneration and allowances for committee members. Specifically, Regulation 26 has been amended by substituting the phrase "Six pounds fifteen shillings" in place of "Five pounds five shillings" in sub-regulation (3)(a), effective from the fifth day of November, 1964. This change impacts the travelling allowance paid to members of committees established under the Therapeutic Substances Act 1953-1959. The intent is to adjust the financial compensation for committee members, reflecting the need to fairly remunerate individuals who dedicate their time to the oversight and regulation of therapeutic substances. The obligations and requirements imposed by these Regulations focus on ensuring that the compensation structure for committee members is updated and reflective of current economic conditions. The amendment to Regulation 26 is explicit in its application to allowances paid or payable from the specified date onwards. This means that any travelling allowance issued to committee members on or after the fifth day of November, 1964, must adhere to the new financial terms set forth in the Regulations. The amendment underscores the importance of timely and accurate remuneration for those involved in regulatory activities, ensuring they are adequately compensated for their contributions. In terms of consequences for non-compliance with these Regulations, there are no explicit offences or penalties stated within the legislative instrument. However, any failure to adhere to the updated remuneration terms could potentially lead to disputes or grievances from committee members regarding the fairness and accuracy of their compensation. Given the formal nature of statutory regulations, such non-compliance could also lead to administrative reviews or further legislative actions to ensure adherence. While specific penalties are not detailed in the text, the emphasis on precise application dates suggests a formal process for enforcing compliance within the regulatory framework.
