Overview
Statutory Rules 1970 No. 140, titled "Regulations under the Therapeutic Substances Act 1953-1959," was enacted by the Governor-General in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council. The regulations were introduced to address the need for updated remuneration for members of committees established under the Therapeutic Substances Act 1953-1959. The problem they sought to rectify was the lack of a current and fair compensation structure for committee members, which could potentially deter qualified individuals from participating in regulatory activities. The objective of the policy is to ensure that committee members are adequately compensated for their time and expertise, thereby maintaining the effectiveness of the committees in overseeing therapeutic substances.
Scope and Application
The Therapeutic Substances Regulations, as amended, apply to meetings of committees established under the Therapeutic Substances Act 1953-1959, specifically regarding the remuneration and allowances for committee members. These regulations govern the fees payable to committee members based on their role, either as the Chairman or a regular member, and the duration of the meetings they attend. The amendments introduced by these regulations apply to committee meetings held on or after 1 September 1969, with specific provisions for meetings that last three hours or more. Notably, these regulations do not extend to meetings shorter than three hours, for which separate fees are stipulated. This legislative instrument is made under the authority of the Therapeutic Substances Act 1953-1959 and is applicable on a national level within Australia.
Key Provisions
The Therapeutic Substances Regulations, made under the Therapeutic Substances Act 1953-1959, introduce changes to the remuneration and allowances for members of Committees. Specifically, Regulation 26 is amended (Regulation 1), adjusting the fees payable to members for their attendance at Committee meetings. If a meeting lasts three hours or more, the Chairman of the Committee will receive $40 per day, while other members will receive $35 (sub-regulation 2). For meetings shorter than three hours, the Chairman will receive $25, and other members will receive $20 (sub-regulation 2a). These amendments apply to meetings held on or after 1 September 1969 (Regulation 2).
These regulations impose specific financial obligations on the members of Committees. The Chairman and other members must be compensated based on the duration of the meetings they attend. This compensation structure is clearly defined, ensuring transparency and fairness in the payment process. The obligation extends to accurately reporting the duration of meetings to ensure the correct fee is calculated and paid.
The regulations do not explicitly state any specific offences, penalties, or civil or criminal consequences for non-compliance. However, failure to adhere to these remuneration and allowance stipulations could potentially lead to disputes or legal challenges regarding the validity of meeting proceedings or decisions made. Given the structured nature of the remuneration provisions, non-compliance might also result in financial discrepancies that could be subject to review or correction by relevant authorities.
