The Parliament of Australia enacts:

1  Short title

  This Act is the Tertiary Education Quality and Standards Agency (Charges) Amendment Act 2021.

2  Commencement

 (1) Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

1.  The whole of this Act

The later of:

(a) immediately after the commencement of the Tertiary Education Quality and Standards Agency (Charges) Act 2021; and

(b) the commencement of the Education Services for Overseas Students (Registration Charges) Amendment Act 2021.

However, the provisions do not commence at all unless both of the events mentioned in paragraphs (a) and (b) occur.

  Legislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.

Tertiary Education Quality and Standards Agency (Charges) Act 2021

1  Subsection 7(4)

Repeal the subsection, substitute:

 (4) For the purposes of subsection (3), disregard any costs that are likely to be offset by fees determined by TEQSA under section 158 of the Tertiary Education Quality and Standards Agency Act 2011.
