Overview

The Terrorism and Cyclone Insurance (End of Cyclone Event – Tropical Cyclone Jasper - (20231214)) Instrument 2023 is a notifiable instrument issued under the authority of the Australian Reinsurance Pool Corporation, specifically by Christopher Wallace, the Chief Executive, acting in accordance with subsection 8F(2) of the Terrorism and Cyclone Insurance Act 2003. This instrument was enacted in response to a notice from the Bureau of Meteorology, declaring the end of the cyclone event associated with Tropical Cyclone Jasper. The primary purpose of this legislation is to formally conclude the previously declared cyclone event, specify the precise time and date when the cyclone ended, and set the concluding date for the claims period related to the cyclone, ensuring that all associated insurance claims are managed within a defined timeframe. The enactment of this instrument aims to provide clarity and structure in managing the aftermath of the cyclone, facilitating an efficient and organised claims process for affected individuals and entities.

Scope and Application

The Terrorism and Cyclone Insurance (End of Cyclone Event – Tropical Cyclone Jasper - (20231214)) Instrument 2023, issued under the Terrorism and Cyclone Insurance Act 2003, applies to entities and persons involved in the administration and management of insurance policies affected by the specified cyclone event. This includes insurers, policyholders, and the Australian Reinsurance Pool Corporation, which has the authority to declare the end of a cyclone event and manage the associated claims period. The instrument delineates the geographic reach by focusing on the area impacted by Tropical Cyclone Jasper, effectively limiting its application to those regions directly affected by the cyclone. The Act does not specify exclusions or exemptions explicitly, but its provisions are designed to streamline and regulate the claims process within a designated timeframe. The authority to make such declarations is extended through subordinate instruments, providing flexibility in managing the aftermath of cyclone events and ensuring that the claims process is timely and efficient. The instrument also specifies the end of the cyclone event and the conclusion of the claims period, providing a clear timeline for all stakeholders involved.

Key Provisions

The main sections of the Terrorism and Cyclone Insurance (End of Cyclone Event – Tropical Cyclone Jasper - (20231214)) Instrument 2023 declare the conclusion of the cyclone event related to Tropical Cyclone Jasper and specify the end time as 12:00 AM [AEST] on 14 December 2023 (section 1). It also sets the end of the claims period for this cyclone event to 16 December 2023 at 12:00 AM [AEST] (section 2). This instrument acts upon a notice from the Bureau of Meteorology and is a declaration by the Chief Executive of the Australian Reinsurance Pool Corporation under the Terrorism and Cyclone Insurance Act 2003 (section 3). The obligations and requirements imposed by this Act include the need for the Chief Executive to act swiftly upon receiving a notice from the Bureau of Meteorology. The declaration of the end of the cyclone event is critical for insurance companies and policyholders to understand the temporal boundaries within which claims must be filed and processed. The Act requires the Chief Executive to ensure that all parties are aware of the end of the claims period, which in this case is 16 December 2023 at 12:00 AM [AEST]. The Chief Executive must also ensure that this information is communicated clearly and accurately to avoid any confusion or disputes regarding the validity of claims submitted after the specified period. In the event of a breach of the provisions set out in this instrument, there are potential civil and criminal consequences. While the instrument does not explicitly state the penalties, breaches of related provisions under the Terrorism and Cyclone Insurance Act 2003 could result in significant fines or other penalties. The precise nature of these penalties would depend on the specific breach and the relevant provisions of the Act. However, it is clear that non-compliance with the declared end of the claims period could lead to legal action against the Chief Executive or the Australian Reinsurance Pool Corporation, potentially impacting their ability to operate within the insurance sector. The exact penalties and consequences would be determined by the courts based on the severity and impact of the breach.
