Overview

The Terrorism and Cyclone Insurance (End of Cyclone Event – Grant - (20260102)) Instrument 2026 is a notifiable instrument enacted by Michael Pennell, the Acting Chief Executive of the Australian Reinsurance Pool Corporation, under the authority granted by subsection 8F(2) of the Terrorism and Cyclone Insurance Act 2003. This instrument was issued in response to a notification from the Bureau of Meteorology regarding the conclusion of Cyclone Grant. It serves to formally declare the end of the cyclone event, which was initially declared through the Terrorism and Cyclone Insurance (Beginning of Cyclone Event – Grant – (20251223)) Instrument 2025 on 23 December 2025. The instrument specifies that the cyclone ended on 02 January 2026 at 4:00 AM [AEST] and sets the final date for claims related to the cyclone event as 4 January 2026 at 4:00 AM [AEST]. This legislative instrument aims to ensure a clear and timely conclusion to the declared cyclone event, facilitating the administration of claims and the return to normal operations within the reinsurance sector. The Terrorism and Cyclone Insurance Act 2003 was introduced to address the financial vulnerabilities of the insurance sector in the event of terrorist activities or severe natural disasters, such as cyclones. The Act provides a framework for the government to intervene and support the insurance industry during such events, ensuring stability and continuity of coverage for policyholders. The enactment of this notifiable instrument reflects the policy objective of efficiently managing the aftermath of natural disasters by providing a definitive timeline for the conclusion of the event and the processing of related claims, thereby protecting both insurers and policyholders during periods of significant risk and uncertainty.

Scope and Application

The Terrorism and Cyclone Insurance (End of Cyclone Event – Grant – (20260102)) Instrument 2026 applies to the Australian Reinsurance Pool Corporation, specifically to the Acting Chief Executive who, under the Terrorism and Cyclone Insurance Act 2003, is empowered to declare the end of a specified cyclone event and the conclusion of the related claims period. This instrument follows a declaration by the Bureau of Meteorology and is geographically targeted at the specific impact of Cyclone Grant, which was previously declared as the beginning of a cyclone event on 23 December 2025. The instrument stipulates that the cyclone event ended on 02 January 2026 at 4:00 AM [AEST] and sets 4 January 2026 at 4:00 AM [AEST] as the final date for claims related to the cyclone. There are no stated exclusions, exemptions, or thresholds in this particular instrument, but the application of the Act may be further defined through subordinate legislation or regulations.

Key Provisions

The main operative sections of the "Terrorism and Cyclone Insurance (End of Cyclone Event – Grant - (20260102)) Instrument 2026" include the declaration of the end of a previously declared cyclone event (subsection 8F(1)) and the specification of the end time of the cyclone (subsection 8F(2)) (section 1). The instrument also details the closure of the claims period for the cyclone event, setting a specific end time for claims to be submitted (section 2). These provisions aim to provide clarity and a structured timeline for the cessation of a declared cyclone event and the subsequent handling of insurance claims related to that event. The obligations imposed by this instrument on the relevant parties include the requirement for the Acting Chief Executive of the Australian Reinsurance Pool Corporation to declare the end of the cyclone event based on a notice from the Bureau of Meteorology. This declaration is essential for ensuring that all stakeholders are aware of the event's conclusion and can transition to the next phase of operations, such as the processing and settlement of insurance claims. Additionally, the instrument mandates a definitive end time for the claims period, which must be adhered to by all entities involved in the insurance process, ensuring a uniform approach to handling claims related to the cyclone. Breaches of the provisions outlined in this instrument can result in significant consequences. While the specific penalties for non-compliance are not detailed in the instrument itself, it is likely that any failure to adhere to the declared end of the cyclone event or the specified claims period could lead to civil or administrative penalties under the Terrorism and Cyclone Insurance Act 2003. These penalties could include fines or other sanctions designed to enforce compliance and ensure the smooth operation of insurance processes in the aftermath of a declared natural disaster. The exact penalties would be determined by the courts or relevant regulatory bodies based on the nature and severity of the breach.
