Overview

The Terrorism and Cyclone Insurance (End of Cyclone Event – Cyclone Mitchell (20260211)) Instrument 2026 is a notifiable instrument enacted to formally declare the conclusion of a cyclone event, specifically Cyclone Mitchell, and to specify the timeline for the claims period associated with that event. This instrument was introduced under the authority of the Terrorism and Cyclone Insurance Act 2003, following a notice from the Bureau of Meteorology. The Act, originally enacted in 2003, was designed to address the unique insurance challenges posed by both terrorist activities and natural disasters such as cyclones, aiming to provide a structured response and recovery process for affected policyholders. The policy objective is to ensure a timely and coordinated end to the claims process, facilitating a smoother transition to recovery efforts. This instrument, signed by Christopher Wallace, Chief Executive of the Australian Reinsurance Pool Corporation, underscores the importance of precise and prompt actions in managing the aftermath of significant natural disasters.

Scope and Application

The Terrorism and Cyclone Insurance (End of Cyclone Event – Cyclone Mitchell (20260211)) Instrument 2026 applies to the insurance policies and claims related to the impact of Cyclone Mitchell, which was declared as a notable event under the Terrorism and Cyclone Insurance Act 2003. This instrument serves to officially mark the cessation of the cyclone event, thereby influencing the timeline for insurance claims. It is pertinent to insurance entities and policyholders who may have been affected by the cyclone. The instrument specifies that the event concluded on 10 February 2026 at 4:00 AM [AEST] and stipulates that the claims period for damages arising from the cyclone will conclude on Thursday 12 February 2026 at 4:00 AM [AEST]. The jurisdictional scope of this instrument is national, applying across all territories and states within Australia, and is mandated by the Terrorism and Cyclone Insurance Act 2003, which authorises the Australian Reinsurance Pool Corporation to issue such instruments in response to significant cyclone events. The instrument itself does not explicitly state any exclusions or exemptions, but these may be defined within the broader act or any subordinate regulations.

Key Provisions

The Terrorism and Cyclone Insurance (End of Cyclone Event – Cyclone Mitchell (20260211)) Instrument 2026, made by Christopher Wallace, Chief Executive of the Australian Reinsurance Pool Corporation, under the authority of the Terrorism and Cyclone Insurance Act 2003, declares the end of the cyclone event associated with Cyclone Mitchell. This instrument, effective from 11 February 2026, follows the earlier declaration of the beginning of the cyclone event. Section 1 of the Instrument declares that the cyclone event concluded on 10 February 2026 at 4:00 AM [AEST], thereby marking the official end of the period of heightened risk and potential claims associated with the cyclone. Section 2 specifies that the claims period for this cyclone event will end on Thursday 12 February 2026 at 4:00 AM [AEST], providing a definitive timeline for insurance-related activities following the cyclone. The Act imposes several obligations on parties involved in the insurance process. Firstly, insurers must adhere to the specified claims period, ensuring all claims are processed within the timeframe outlined in the Instrument. This includes providing necessary documentation and settling claims in accordance with policy terms. Additionally, the Instrument mandates that all claims related to the cyclone event be submitted by the stated deadline, 12 February 2026 at 4:00 AM [AEST]. Failure to comply with these deadlines could result in the forfeiture of any claims, as outlined in the relevant policies and the Act itself. Insurers and policyholders must also ensure that all claims are supported by adequate documentation, verifying the extent of damages and losses incurred due to the cyclone. Breach of the provisions set forth in the Instrument could result in significant consequences. Firstly, insurers failing to process claims within the stipulated period may face regulatory scrutiny and potential penalties under the Terrorism and Cyclone Insurance Act 2003. Such penalties could include fines or other administrative sanctions imposed by relevant authorities. Furthermore, policyholders who do not submit claims by the specified deadline may lose their right to compensation for damages resulting from the cyclone. The Act provides mechanisms for enforcing compliance, ensuring that all parties adhere to the declared timelines and conditions, thereby maintaining the integrity of the insurance process during and after a declared cyclone event.
