Overview

The Terrorism and Cyclone Insurance (Beginning of Cyclone Event – Tropical Cyclone Zelia – (20250212)) Instrument 2025 is a notifiable instrument issued under the Terrorism and Cyclone Insurance Act 2003. Enacted by the Australian Reinsurance Pool Corporation, the instrument was introduced to address the need for timely and precise declarations regarding the commencement of cyclone events, specifically in response to Tropical Cyclone Zelia. The declaration marks the beginning of the claims period for insurance purposes, facilitating prompt and effective management of claims related to the cyclone. This instrument was issued by Christopher Wallace, Chief Executive of the Australian Reinsurance Pool Corporation, acting under a notice from the Bureau of Meteorology and pursuant to the authority granted by subsection 8F(1) of the Act. The policy objective is to ensure that insurance providers can swiftly address claims arising from declared cyclone events, thereby maintaining the stability and efficiency of the insurance system during natural disasters.

Scope and Application

The Terrorism and Cyclone Insurance (Beginning of Cyclone Event – Tropical Cyclone Zelia – (20250212)) Instrument 2025 applies specifically to the declaration of a cyclone event in relation to Tropical Cyclone Zelia, commencing on 12 February 2025 at 4:00 AM [AEST]. This instrument is issued under the authority of the Australian Reinsurance Pool Corporation and is triggered by a notice from the Bureau of Meteorology. The Act applies to insurance providers, policyholders, and relevant entities within the insurance sector that are impacted by the declared cyclone event, thereby setting a defined claims period from the onset of the cyclone. This instrument has a jurisdictional reach that aligns with the provisions of the Terrorism and Cyclone Insurance Act 2003 and extends to all areas affected by Tropical Cyclone Zelia. The instrument does not specify any exclusions or exemptions, but it does establish a clear timeline for when the cyclone event is considered to have begun and when the claims period for related insurance incidents starts, thereby ensuring a uniform approach to handling insurance claims arising from the cyclone.

Key Provisions

The main operative sections of the Terrorism and Cyclone Insurance (Beginning of Cyclone Event – Tropical Cyclone Zelia – (20250212)) Instrument 2025 declare that a cyclone event has begun in relation to Tropical Cyclone Zelia (section 1). The instrument specifies the exact date and time that the cyclone began, which is 12 February 2025 at 4:00 AM [AEST] (section 2), and also establishes that the claims period for this cyclone event commenced at the same moment (section 3). This instrument is a formal declaration made by Christopher Wallace, the Chief Executive of the Australian Reinsurance Pool Corporation, acting under the authority granted by subsection 8F(1) of the Terrorism and Cyclone Insurance Act 2003, following a notice from the Bureau of Meteorology. The Act imposes several obligations and requirements on the parties and entities it governs. Firstly, it mandates that the Chief Executive of the Australian Reinsurance Pool Corporation must act upon a notice from the Bureau of Meteorology to declare the beginning of a cyclone event. This ensures a timely and coordinated response to the declared cyclone event. Additionally, it requires the Chief Executive to specify the exact date and time the cyclone began, as well as the start of the claims period, ensuring clarity and consistency for all stakeholders involved. These provisions help streamline the insurance claims process and ensure that all parties are aware of the timelines involved. Failure to comply with the provisions of this instrument could lead to several consequences. Although specific offences, penalties, or consequences are not detailed in the instrument itself, breaches of similar provisions under the Terrorism and Cyclone Insurance Act 2003 may result in significant civil or criminal penalties. For instance, knowingly making a false statement in relation to a claim could lead to criminal charges, with potential penalties including fines and imprisonment. Furthermore, entities failing to adhere to the declared claims period might face substantial financial repercussions, including the inability to recover costs or damages through insurance mechanisms. It is important for all involved to strictly comply with the declared timelines and requirements to avoid any adverse outcomes.
