Overview

The Terrorism and Cyclone Insurance (Beginning of Cyclone Event – Tropical Cyclone Sean – (20250119)) Instrument 2025 was enacted to address the specific issue of delineating the beginning of a cyclone event for insurance claim purposes in the context of Tropical Cyclone Sean. This notifiable instrument was introduced by Victoria Simpson, the Chief Executive (Acting) of the Australian Reinsurance Pool Corporation, acting under subsection 8F(1) of the Terrorism and Cyclone Insurance Act 2003. The enactment follows a notice from the Bureau of Meteorology and aims to ensure a clear and precise determination of when the cyclone event commenced, thereby facilitating timely and accurate claims processing within the established framework of the Act. The underlying policy objective is to provide certainty and streamline the claims process for affected policyholders during natural disaster events.

Scope and Application

The Terrorism and Cyclone Insurance (Beginning of Cyclone Event – Tropical Cyclone Sean – (20250119)) Instrument 2025 applies to all entities and individuals involved in the provision of insurance policies in Australia, particularly those covered under the Terrorism and Cyclone Insurance Act 2003. The instrument was issued in response to a declaration by the Bureau of Meteorology regarding the commencement of Tropical Cyclone Sean, initiating a defined claims period for insurance policies that may be affected by the cyclone. The instrument delineates the geographic scope by identifying the commencement of the cyclone event at a specific time and date, which is effective across the areas impacted by Tropical Cyclone Sean. The application of this instrument extends throughout the Commonwealth of Australia, ensuring that all relevant parties, including insurers and policyholders, are aware of the commencement and implications of the cyclone event. This instrument does not introduce new exclusions or exemptions but rather clarifies the operational framework under the Terrorism and Cyclone Insurance Act 2003 for the specified cyclone event.

Key Provisions

The main operative sections of the Terrorism and Cyclone Insurance (Beginning of Cyclone Event – Tropical Cyclone Sean – (20250119)) Instrument 2025 declare that a cyclone event has begun in relation to Tropical Cyclone Sean, specifying the exact date and time of the commencement of the cyclone event, and stating the beginning of the claims period for this event (sections 1 and 2). This legal instrument is a notifiable instrument issued under the Terrorism and Cyclone Insurance Act 2003, and it is intended to formally recognise the onset of a cyclone event and to establish the timeline for insurance claims related to that event. By specifying the date and time, the instrument ensures that all parties involved, including insurers, policyholders, and the Australian Reinsurance Pool Corporation, have a clear understanding of when the cyclone event began and when the claims period starts. The obligations and requirements imposed by this Act on the parties it governs include the formal declaration of the cyclone event and the commencement of the claims period. For insurance companies, this means that they must be prepared to handle claims related to Tropical Cyclone Sean from the specified start time on 19 January 2025 at 10:00 AM [AEST]. Policyholders, in turn, must ensure that they initiate their claims within the prescribed period, which begins at the same specified time. The instrument also places a duty on the Australian Reinsurance Pool Corporation to act in accordance with the declared event, ensuring that the reinsurance mechanisms are activated and operational from the onset of the event. Failure to comply with the provisions of this instrument could result in civil or criminal consequences. While the specific offences, penalties, or consequences are not detailed in the instrument itself, breaches of the Terrorism and Cyclone Insurance Act 2003 could lead to penalties as stipulated in the Act. Generally, under the Act, individuals or entities that fail to adhere to the requirements for declaring a cyclone event or the commencement of the claims period may face fines or other legal repercussions. The maximum penalties for breaches of the Act can vary, but they are typically set out in the Act and could include substantial fines for both individuals and corporate entities. Additionally, in cases of severe non-compliance, criminal charges could be pursued, leading to further legal and financial consequences.
