Overview

The Terrorism and Cyclone Insurance (Beginning of Cyclone Event – Tropical Cyclone Dianne – (20250328)) Instrument 2025, issued under the Terrorism and Cyclone Insurance Act 2003, was enacted to address the commencement of a specific cyclone event, Tropical Cyclone Dianne, on 28 March 2025 at 5:00 PM [AEST]. This instrument was promulgated by Christopher Wallace, the Chief Executive of the Australian Reinsurance Pool Corporation, acting under the authority delegated by the Act, in response to a notice from the Bureau of Meteorology. The primary objective of this legislation is to formally declare the beginning of a cyclone event and to establish the claims period in response to such an event, ensuring a timely and coordinated response from relevant authorities and entities. The Terrorism and Cyclone Insurance Act 2003 was established by the Parliament of Australia to provide a framework for the management of terrorism and cyclone insurance risks. This specific instrument aims to clarify the commencement of a cyclone event and the subsequent claims period, facilitating the efficient processing of insurance claims related to the specified natural disaster.

Scope and Application

The Terrorism and Cyclone Insurance (Beginning of Cyclone Event – Tropical Cyclone Dianne – (20250328)) Instrument 2025 applies to all entities and individuals involved in insurance transactions within the scope of the Terrorism and Cyclone Insurance Act 2003, particularly those concerning the reinsurance of risks associated with terrorism and cyclones. This instrument specifically identifies Tropical Cyclone Dianne as the event that has triggered the commencement of the claims period, and it delineates the exact time and date of the cyclone's onset, which is 5:00 PM [AEST] on 28 March 2025. The geographic reach of this Instrument is defined by the areas impacted by Tropical Cyclone Dianne, aligning with the jurisdictional authority of the Australian Reinsurance Pool Corporation, thereby extending its application to all relevant territories affected by the cyclone within Australia. The Instrument is an extension of the Terrorism and Cyclone Insurance Act 2003 and does not introduce any exclusions or exemptions beyond those already established in the primary legislation. Its implementation is further guided by subordinate instruments, which may provide additional specifics or operational details necessary for the administration of claims under this Act.

Key Provisions

The key operative sections of the Terrorism and Cyclone Insurance (Beginning of Cyclone Event – Tropical Cyclone Dianne – (20250328)) Instrument 2025 (F2025N00289) declare that a cyclone event has begun in relation to Tropical Cyclone Dianne and specify the precise time the cyclone began (section 1). It also sets the commencement of the claims period for this cyclone event, which aligns with the moment the cyclone began (section 2). These sections are crucial as they formalise the start of the insured event and the subsequent period during which claims can be made under relevant policies. The Act imposes specific obligations and requirements on the parties involved. The declaration and specification of the cyclone event and the start of the claims period are pivotal for insurers, policyholders, and the Australian Reinsurance Pool Corporation. Insurers must be prepared to handle claims from the moment the claims period begins, while policyholders must ensure their claims are lodged within the specified timeframe. The Australian Reinsurance Pool Corporation, in turn, must facilitate the claims process and ensure that the provisions of the Terrorism and Cyclone Insurance Act 2003 are adhered to throughout the claims period. Failure to comply with the provisions of the Act could result in various consequences. While the specific offences and penalties are not detailed in this instrument, breaches of the Terrorism and Cyclone Insurance Act 2003 could lead to civil or criminal penalties, depending on the nature and severity of the breach. Under the principal Act, penalties for non-compliance might include fines and, in more severe cases, imprisonment. The exact penalties would be determined based on the specific provisions of the Terrorism and Cyclone Insurance Act 2003 that are contravened. It is essential for all parties to adhere to the requirements set out in the Act to avoid these potential consequences.
