Overview

The Tax Agent Services Act 2009 (TASA) was enacted to regulate the provision of tax (financial) advice by ensuring that tax (financial) advisers meet certain standards of competence and conduct. The Act was introduced to address the problem of inadequate regulation in the tax (financial) advice sector, which could potentially harm consumers. The objective of the Act is to protect consumers by ensuring that tax (financial) advisers are competent, act with integrity, and comply with professional standards. The Act is administered by the Tax Practitioners Board, which has the power to terminate the registration of tax (financial) advisers who no longer meet the registration requirements or have breached the code of professional conduct. The policy objective is to maintain public confidence in the tax (financial) advice sector by ensuring that only qualified and trustworthy advisers are allowed to provide tax (financial) advice.

Scope and Application

The Tax Agent Services Act 2009 (TASA) applies to tax practitioners, which includes individuals and entities that provide tax (financial) advice services in Australia. The Act establishes a regulatory framework for the conduct, registration, and professional standards of tax practitioners to ensure compliance with legislative requirements and to protect the interests of clients. The Act operates at the Commonwealth level, meaning it applies across Australia, encompassing all states and territories. The Act may be extended or restricted through subordinate instruments, such as regulations, codes of conduct, and guidelines, which provide further detail on the implementation of the Act’s provisions. The Act includes certain exclusions, such as individuals who provide tax advice purely as an ancillary part of their primary business or profession, and thresholds that determine the applicability of registration requirements. The termination of registration under the Act may occur for reasons such as surrender of registration, failure to comply with the code of professional conduct, or no longer meeting the registration requirements, as evidenced by the listed cases of termination in the gazette.

Key Provisions

The Tax Agent Services Act 2009 (TASA) contains provisions for the registration of tax agents and financial advisers, as well as mechanisms for their deregistration. Under subdivision 40-A (sections 40-320 to 40-345), the Tax Practitioners Board has the authority to terminate the registration of tax agents or financial advisers who no longer meet the required standards. This can occur either due to the individual or entity voluntarily surrendering their registration (section 40-330), or because they no longer meet the registration requirements (section 40-325). The operative sections in this context require that the Board provide reasons for the termination and publish the details in the Gazette, as seen with the termination of numerous tax agents on 21/04/2020, and one entity, Expert Wealth Management Pty Ltd, on 14/04/2020, due to failure to comply with the code of professional conduct. The obligations imposed on tax agents and financial advisers include maintaining professional standards and compliance with the relevant codes of conduct. Any failure to meet these standards can lead to termination of their registration. Additionally, under subdivision 30-B (sections 30-160 to 30-175), entities can be deregistered for failing to comply with the code of professional conduct, as evidenced by the termination of Expert Wealth Management Pty Ltd. Breach of these obligations can result in significant consequences. The Act allows for both civil and criminal penalties. Under section 40-340, a financial penalty of up to $21,000 may be imposed for breaches of the Act or regulations. Furthermore, under section 40-345, a court may order the forfeiture of any benefit obtained through the breach, adding another layer of financial disincentive for non-compliance. These provisions are designed to ensure that tax agents and financial advisers operate within the legal framework and maintain high standards of professional conduct.
