Overview

The Statutory Rules 1962, No. 65, made under the Post and Telegraph Act 1901-1961, were introduced to amend the existing Telephone Regulations. Enacted by the Administrator of the Government of the Commonwealth of Australia, with the advice of the Federal Executive Council, these Regulations sought to update and refine the administrative framework governing telephone services across various regions. The primary objective of these amendments was to ensure that the telephone service provisions remained current and accurate, reflecting any changes in regional designations or service areas. This legislative instrument aimed to maintain the efficiency and effectiveness of the postal and telegraph services by keeping the regulatory framework aligned with the evolving needs of the communities it served.

Scope and Application

The Regulations under the Post and Telegraph Act 1901-1961, specifically amending the Telephone Regulations, apply to the administration and management of telephone services within the Commonwealth of Australia. These regulations govern entities such as telecommunications companies and service providers who operate under the Post and Telegraph Act. The amendments concern the geographic areas and specific locations where telephone services are to be provided or adjusted, impacting both urban and rural areas as noted in the schedules. The geographic reach of these regulations is nationwide, applying uniformly across all states and territories in Australia. These regulations do not explicitly state any exclusions, exemptions, or thresholds, but they do detail specific amendments to the existing telephone service areas and provider associations. The application of these regulations may be further extended or restricted through subordinate instruments as deemed necessary by the relevant authorities.

Key Provisions

The key provisions of these Regulations (Statutory Rules 1962, No. 65) are found in the First and Second Schedules, which detail amendments to the Telephone Regulations. These amendments pertain to the geographic coverage of telephone services and adjustments to the regulatory framework governing telephone services (Schedule 1, Regulation 2; Schedule 2, Regulation 3). The Regulations are set to come into operation on 13 August 1962 (Regulation 1). The amendments primarily involve realigning and updating the areas covered under telephone services, as well as correcting and clarifying certain entries within the regulatory schedules. The Regulations impose obligations on telephone service providers to ensure that their services align with the updated geographic and regulatory frameworks outlined in the amended schedules. Service providers must adjust their service areas to reflect the changes, ensuring that all specified localities are correctly listed and serviced (Schedule 1, Regulation 2; Schedule 2, Regulation 3). Additionally, these amendments require that any documentation, maps, and service agreements be updated to reflect the new regulatory structure, ensuring compliance with the latest requirements. There are no explicit offences, penalties, or consequences for non-compliance detailed within these Regulations. However, failure to adhere to the updated geographic and regulatory frameworks could result in non-compliance with the overarching Post and Telegraph Act 1901-1961. Such non-compliance could potentially lead to enforcement actions, fines, or other penalties as stipulated under the broader legislative framework, although specific penalties are not detailed in these Regulations. The service providers are expected to ensure that they are operating in accordance with the updated regulatory requirements to avoid any potential legal repercussions.
