Overview

The Statutory Rules 1962, No. 9, Regulations under the Post and Telegraph Act 1901-1960, were enacted to amend the existing Telephone Regulations. These regulations were brought into operation on 29 January 1962, following notification in the Commonwealth Gazette on 25 January 1962. The objective of these amendments was to update and refine the regulatory framework governing telephone services, ensuring it met the contemporary needs and standards of the time. The enactment was authorised by the Governor-General in Council, reflecting the legislative process of the Commonwealth of Australia. The specific changes, detailed in the First Schedule, primarily involved adjustments to the geographical allocations and service areas listed within the Telephone Regulations, indicating a focus on improving the efficiency and coverage of telephone services across specified locations.

Scope and Application

The Regulations under the Post and Telegraph Act 1901-1960, as stipulated in Statutory Rules 1962, No. 9, primarily serve to amend the Telephone Regulations. These amendments are detailed in the First Schedule and aim to update specific geographical references within the existing framework, enhancing the clarity and accuracy of the regulatory provisions governing telecommunications services. The changes include inserting and omitting certain place names within the designated columns of Parts 3 and 4 of the First Schedule, thereby refining the allocation of telecommunications services across various locations. These regulations apply to entities and persons involved in the provision and regulation of telephone services within the Commonwealth of Australia, impacting their operations and service delivery. The amendments do not explicitly state any exclusions, exemptions, or thresholds but are aimed at ensuring the regulatory framework remains current and effective. The regulations are effective from 29 January 1962, as specified in the commencement clause, and any further elaboration or extension of their application is left to potential subordinate instruments or further statutory amendments.

Key Provisions

The Statutory Rules 1962, No. 9, made under the Post and Telegraph Act 1901-1960, focus primarily on amendments to the existing Telephone Regulations. These Regulations came into effect on the twenty-ninth day of January, 1962, as stated in section 1. The primary changes are detailed in the First Schedule (section 2), which modifies the First Schedule to the Telephone Regulations. Specifically, it involves alterations to the geographical areas covered by certain services or provisions, as outlined in the detailed amendments listed in the Schedule. The amendments in the First Schedule (Regulation 2) specifically target the locations listed in Part 3 and Part 4, introducing changes such as the addition of "Lochnagar" and "Rendelsham" to the list of areas served, and the adjustment of service areas for "Barcaldine", "Jericho", "Greenways", and "Robe". For instance, the area previously served by "Beta" is now attributed to "Lochnagar", and "Rendelsham" is replaced by "Robe" (Regulation 2.2 and 2.4). These changes likely reflect updates to the service areas covered by the telephone network, possibly due to changes in population distribution, infrastructure development, or other factors impacting service delivery. Entities governed by these Regulations are required to ensure compliance with the updated service areas outlined in the amended First Schedule. This involves making the necessary adjustments to their service provision to reflect the changes specified, which may include reassigning service responsibilities or updating operational records to align with the new geographical demarcations. Breaches of these Regulations could potentially lead to legal consequences, although the specific penalties are not detailed within the document itself. Typically, under the Post and Telegraph Act 1901-1960, non-compliance with regulations might result in penalties as prescribed by law, which could include fines or other enforcement actions. The exact nature and severity of these penalties would depend on the specific circumstances and the relevant legal provisions.
