Overview

The Statutory Rules 1961 No. 75, Regulations under the Post and Telegraph Act 1901-1960, were enacted to amend existing telephone regulations. This legislative instrument was made under the authority of the Deputy of the Administrator of the Commonwealth of Australia, with the advice of the Federal Executive Council. The primary objective of these regulations is to update the administrative framework governing telephone services, ensuring alignment with contemporary needs and practices. These regulations came into effect on 19 June 1961, as specified in the text. They include amendments to various schedules that detail specific changes to telephone service areas and their respective codes, aiming to refine the geographic coverage and operational definitions within the telecommunications sector.

Scope and Application

The Regulations Under the Post and Telegraph Act 1901-1960, specifically amending the Telephone Regulations, apply to various entities involved in telecommunications services within Australia, including those that operate or provide telephone services. The geographic reach of these regulations is national, as they are promulgated under the Commonwealth of Australia's authority. The regulations detail amendments to the First and Second Schedules of the Telephone Regulations, impacting a range of locations and services by adding, omitting, or modifying entries related to telephone exchanges and their associated areas of service. The amendments come into operation on 19 June 1961, as specified by the regulations. There are no explicit exclusions or exemptions mentioned within the text, and any further specification or restriction of application would likely be addressed through subordinate instruments or additional legislation.

Key Provisions

The Regulations under the Post and Telegraph Act 1901-1960, made on the sixth day of June 1961, primarily involve amendments to the existing Telephone Regulations. These amendments are detailed in the First and Second Schedules to the Regulations. The Regulations are set to come into operation on the nineteenth day of June 1961. The First Schedule to the Telephone Regulations includes detailed changes to the list of telephone exchanges and their associated areas. It involves the insertion, omission, and replacement of various place names to ensure the list accurately reflects current postal and telephone service areas. For example, the word "Bonshaw" is inserted into column 3 of Part 1 at the beginning of the words specified opposite the word "Ashford" in column 1. Similarly, the word "Narrabri" is omitted from column 3 opposite to the words "Baan Baa" in column 1, and "GhoolendaadiNarrabri" is inserted in its place. These amendments ensure that the telephone exchange areas are correctly aligned with postal and geographic realities. The Second Schedule to the Telephone Regulations also involves amendments to the list of exchanges and their associated areas. For instance, the word "Waropurra" is omitted from column 2 of Part 1 opposite to the word "Glen Innes" in column 1. Furthermore, the word "Dungowan" is omitted from column 2 of Part 1 opposite to the word "Tamworth" in column 1. These changes aim to ensure the accuracy and efficiency of telephone service delivery. The Regulations impose specific obligations on the parties they govern, primarily ensuring that the telephone exchange areas and their associated places are accurately and efficiently managed. These obligations include maintaining updated and correct records of telephone exchange areas, ensuring that the changes made in the Schedules are implemented correctly, and providing the necessary infrastructure to support the amended areas. Failure to comply with these Regulations can result in civil or criminal consequences. While specific penalties are not detailed within the text of the Regulations, breaches of similar statutory instruments typically result in fines or other legal repercussions as stipulated under the governing Act. It is important for the governed parties to adhere strictly to the amendments to avoid any potential legal issues.
