Overview

The Statutory Rules 1972 No. 38, made under the Post and Telegraph Act 1901-1971, introduced amendments to the existing telephone charging regulations. These regulations were necessary to update the charging zones and districts to reflect changes in population and telecommunications infrastructure. Enacted by the Governor-General with the advice of the Federal Executive Council, these regulations aimed to provide clearer and more accurate delineation of zones and districts to ensure that telephone charges were applied fairly and efficiently across the country. The policy objective was to streamline the administration of telephone services and improve the accuracy of billing by updating the geographic zones and districts used for determining call charges. These amendments, which came into operation on 25 September 1972, involved a series of changes to both the Second and Third Schedules of the Telephone (Charging Zones and Charging Districts) Regulations. The changes included the addition and omission of various locations to ensure that the charging districts accurately reflected current geographic and demographic realities. By updating these zones and districts, the regulations aimed to support the efficient operation of the national telecommunications network while ensuring that consumers were charged correctly for their telephone services.

Scope and Application

The Regulations under the Post and Telegraph Act 1901-1971 pertain to the amendments of the Telephone (Charging Zones and Charging Districts) Regulations, specifically targeting the geographical areas and their associated zones and districts for telephone services. These regulations apply to all persons and entities within the Commonwealth of Australia, including telecommunications providers and their customers, by adjusting the geographical boundaries of charging zones and districts. The regulations establish specific areas and their corresponding zones and districts, affecting the way telephone charges are calculated and applied across different regions. The scope of these regulations is limited to the specified amendments listed in the schedules, which include adding, omitting, or modifying locations to refine the delineation of zones and districts. There are no stated exclusions, exemptions, or thresholds in these particular regulations. The application and enforcement of these regulations are facilitated through subordinate instruments, which may further define the operational aspects of telecommunications services within the newly adjusted zones and districts.

Key Provisions

The regulations made under the Post and Telegraph Act 1901-1971 primarily address amendments to the Telephone (Charging Zones and Charging Districts) Regulations (section 2). The Second Schedule to these regulations (section 2) contains amendments to the charging zones and districts, including omitting certain localities such as Anglers Reach, Sweetman's Creek, and Crowdy Head, and inserting new localities such as Curramanga, Warrumbungle, and Golden Beach. Additionally, there are corrections in the spelling of certain localities such as Porongurup, replacing the incorrect spellings of Porongorups. The Third Schedule (section 3) also sees amendments, including the insertion of new localities such as Golden Beach, Uaroo, and Yarraloola, and the omission of others such as Paradise Beach and Mount Lindsay. These regulations impose specific obligations on telecommunications service providers to adjust their billing and service areas according to the new zones and districts outlined in the amended schedules. The changes necessitate that providers update their records and systems to reflect the new localities, ensuring that charges and services are correctly applied in accordance with the revised geographical boundaries. Breaches of these regulations, such as failure to correctly apply the updated charging zones and districts, could result in penalties. While the specific penalties are not detailed within these regulations, breaches of telecommunications regulations generally could result in substantial fines under the Telecommunications Act 1997. The penalties can vary based on the severity of the breach, with maximum fines potentially reaching into the millions of Australian dollars for significant or repeated violations. Additionally, such breaches may also attract civil consequences, including compensation claims from affected consumers or businesses.
