Overview

The Post and Telegraph Act 1901-1966, enacted by the Parliament of Australia, aimed to regulate the provision of postal and telegraph services throughout the country. The Act sought to address issues related to the administration, operation, and regulation of postal and telegraph services, ensuring efficient and reliable communication infrastructure. The accompanying statutory rules and regulations, such as the 1968 amendments to the Telephone (Charging Zones and Charging Districts) Regulations, further refine and update the legislative framework to accommodate changes in technology and service delivery. These amendments typically involve adjustments to the delineation of charging zones and districts to better reflect the current geographical and population distributions, ensuring that the regulatory framework remains effective and equitable. The policy objective is to maintain a robust and accessible communication infrastructure that supports the needs of the Australian public and businesses.

Scope and Application

The Regulations under the Post and Telegraph Act 1901-1966 apply to the amendments of the Telephone (Charging Zones and Charging Districts) Regulations, specifically targeting the geographic zones and districts designated for telephone charging purposes across Australia. These Regulations are applicable to the Commonwealth and affect telecommunications services by altering the geographical demarcation of charging zones and districts. The changes include the addition and removal of specific localities within the existing zones and districts, thereby affecting how telephone services are charged. The Regulations do not explicitly state any exclusions or exemptions, but the modifications are specific to the localities listed in the schedules, thereby directly affecting the areas mentioned. The Regulations are made under the authority of the Governor-General and are implemented through statutory rules, with further potential amendments possible through subordinate instruments.

Key Provisions

These regulations amend the existing Telephone (Charging Zones and Charging Districts) Regulations, with changes coming into effect on the twenty-ninth day of April 1968 (Regulation 1). The First Schedule (Regulation 2) lists a series of amendments to the geographical areas covered by the charging zones and charging districts, including the omission of several localities and the addition of new ones, such as "Taggerty". For example, "Craboon" is omitted from column 3 of item 191 in Part I, while "Taggerty" is added after "Pine Lea" in column 3 of item 210 of Part I. Additionally, the First Schedule also includes the addition of new items and the reconfiguration of existing items to reflect these changes. The regulations impose specific obligations on the parties governed by them, namely, the correct identification and classification of charging zones and districts within the scope of the Post and Telegraph Act 1901-1966. These obligations include the accurate updating of geographical data to ensure that the charging zones and districts reflect the current administrative divisions and localities in Australia. The regulations also require the relevant authorities to ensure that the changes outlined in the schedules are implemented in a timely and efficient manner. There are no specific offences, penalties, or civil/criminal consequences mentioned in these regulations. However, non-compliance with the requirements of the Post and Telegraph Act 1901-1966, as amended by these regulations, may result in legal action being taken against the parties or entities responsible for the breach. The potential penalties for non-compliance would be determined by the specific provisions of the Act and the nature of the breach. The regulations themselves serve as a framework for updating and maintaining the accuracy of the charging zones and districts, rather than imposing specific penalties or consequences for non-compliance.
