Overview

The Statutory Rules 1973 No. 49, titled "Regulations Under the Post and Telegraph Act 1901-1971," were enacted by the Governor-General in accordance with the advice of the Federal Executive Council. These regulations were introduced to amend the existing Telephone (Charging Zones and Charging Districts) Regulations. The aim of these amendments was to update the geographical delineations of various charging zones and districts for telephone services across different regions. This legislative instrument reflects the continual effort to refine and adjust the regulatory framework governing telecommunications to meet contemporary needs and ensure equitable service provision. The regulations came into operation on the twenty-sixth day of February, 1973.

Scope and Application

The Regulations under the Post and Telegraph Act 1901-1971 apply to the Commonwealth of Australia and are made by the Governor-General in accordance with the advice of the Federal Executive Council. These regulations specifically amend the Telephone (Charging Zones and Charging Districts) Regulations, effective from 26 February 1973. The amendments involve modifying geographical entries in the Second and Third Schedules of the regulations, including the addition, omission, and re-sequencing of specific locations and zones pertinent to telephone charging districts. These changes affect the delineation of charging zones and districts for telephone services across various regions in Australia. There are no stated exclusions or exemptions within these regulations, and the application extends to all entities and persons involved in the telecommunications sector within the defined geographical boundaries.

Key Provisions

The Regulations under the Post and Telegraph Act 1901-1971, made on 5 March 1973, primarily serve to amend the Telephone (Charging Zones and Charging Districts) Regulations. The main operative sections of these regulations involve the amendment of the Second Schedule (Regulation 2) and the Third Schedule (Regulation 3). Regulation 2 outlines changes to the Second Schedule, which primarily involve the omission and insertion of specific localities within the charging zones and districts. For example, it includes the omission of localities such as "Upper Kangaroo River", "Maryvale", and "Limeburner’s Creek" from certain columns and the insertion of new localities such as "Tongala", "Hunter's Hill", and "Gredgwin Rail". Similarly, Regulation 3 pertains to amendments of the Third Schedule, which involve the addition and substitution of localities within the charging zones and districts. These Regulations impose specific obligations on the parties governed by them, primarily concerning the reclassification and redefinition of localities within the charging zones and districts as specified in the amended schedules. The changes necessitate that relevant authorities, such as telecommunications providers and regulatory bodies, update their records and systems to reflect these modifications. This includes ensuring that billing and service provision accurately reflect the new classifications and localities. The Regulations do not explicitly outline specific offences, penalties, or civil/criminal consequences for breaches. However, failure to comply with these amendments could result in non-compliance with the overarching Post and Telegraph Act 1901-1971, potentially leading to legal ramifications as defined under the principal Act. The principal Act might encompass provisions for penalties, fines, or other sanctions for non-compliance with regulatory requirements related to postal and telecommunications services.
